RECOMMENDED ACTION:
Adopt Resolution No. 1177 to quitclaim an existing waterline easement across
APN: 21 1-1 00-04, being a portion of Lot 12 of Map No. 13408.
ITEM EXPLANATION:
Palomar Cannon Partnership, a California General Partnership has submitted a request to quitclaim
that portion of a waterline easement that traverses over APN 21 1-100-04, being a portion of Lot 12,
Map No. 13408.
With the development of Carlsbad Ranch, CT 94-09, new waterlines constructed in Fleet Street and
Armada Drive replaced the old waterlines across Lot 12 of Map No. 13408. The old waterlines were
abandoned with the activation of new ones in Fleet Street and Armada Drive.
Staff concurs with the owner that there are no waterline facilities within the easement and the
easement is no longer necessary. The easement can be quitclaimed to the owner.
ENVIRONMENTAL REVIEW:
The proposed quitclaim is exempt from environmental review under the California Environmental
Quality Act Section 15061(b)(3), because it can be seen with certainty that there is no possibility that
the quitclaim may have a significant effect on the environment.
FISCAL IMPACT:
This item has no fiscal impact to the City. The waterline easement was granted to the District for a no
cost acquisition and the District will quitclaim the easement for a no cost return to the property owner.
The owner has paid the standard fee for processing this quitclaim.

RESOLUTION NO. 1177
A RESOLUTION OF THE BOARD OF DIRECTORS OF
CARLSBAD MUNICIPAL WATER DISTRICT (CMWD) TO
QUITCLAIM AN EXISTING WATERLINE EASEMENT
MAP NO. 13408.
ACROSS APN: 21 1-100-04 BEING A PORTION OF LOT 12,
WHEREAS, a replacement waterline system was constructed with the development of
>arkbad Ranch, CT 94-09; and
WHEREAS, the waterline across APN: 21 1-100-04 has been removed from service and
he waterline easement is no longer needed.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal
Nater District (CMWD) of the City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the Carlsbad Municipal Water District (CMWD) quitclaim the existing waterline
zasement across APN: 21 1-100-04, being a portion of Lot 12, Map No. 13408.
PASSED, APPROVED AND ADOPTED at a special meeting of the Carlsbad Municipal
iNater District held on the 4th day of March , 2003 by the following vote, to wit:
AYES:Board Members Lewis, Finnila, Kulchin, Hall and Packard.
NOES: None.
ABSENT: None.
