CITY MGR. ?b.Lt RECOMMENDED ACTION: Carlsbad Municipal Water District: Adopt Resolution No. 1189 to approve and authorize appropriation transfer to the Effluent Flow Equalization Joint Use Facilities, Project No. 38881, and the Recycled Pipelines, Project No. 38871, from funding appropriated for Carlsbad Water Recycling Facility, Project No. 36753. ITEM EXPLANATION: The “Effluent Flow Equalization Joint Use Facilities” (Joint Use Facilities) is a project, which the Encina Wastewater Authority (EWA) has designed and proposes to construct. This project has two purposes. First, it provides emergency storage of secondary treated wastewater to relieve the capacity of EWA’s ocean outfall. Second, it provides finished water storage of tertiary treated water for the Carlsbad Water Recycling Facility, which is now under construction, and also provides influent and finish water pumping stations. On March 5, 2002, under Agenda Bill No. 16676, the City Council approved an agreement with EWA to have them design and construct the Joint Use Facilities with proportional share funding from the Carlsbad Municipal Water District. At the time, it was estimated that Carlsbad’s share of the project cost would need to be appropriated in the amount of $2,970,000. Carlsbad’s cost share was based on a 25 percent share of the overall project cost with $360,000 in design cost and $2,610,000 in construction cost. EWA has completed the design of the Joint Use Facilities and, based on the current Engineer’s Estimate, has notified Carlsbad that Carlsbad’s percent share of the design and construction costs have increased to 28.36 percent, and the estimated project cost has increased from $1 1,247,000 to $1 3,338,370. As a result of the increase in percent share and overall project cost, Carlsbad’s share of the project cost is now estimated at $3,936,000. The increase in the project share cost requires that the appropriation for the project be increased. ENVIRONMENTAL REVIEW: A Mitigated Negative Declaration was prepared for the Phase II project and approved by the City Council on January 25,2000 under case no. EIA 99-09. FISCAL IMPACT: Based on updated information provided by EWA, Carlsbad’s share of the Joint Use Facilities has increased to $3,936,000. A portion of the excess appropriations from the Carlsbad Water Recycling Facility (CWRF), now under construction, will be used to fund this increase. These excess funds resulted from construction bids for the CWRF being lower than the Engineer’s Estimate by $1.3 million and because existing and projected change orders and miscellaneous expenses are lower than budgeted. The remainder of the excess appropriations from the CWRF project will be transferred to the Phase I1 Recycled Pipelines project. The current Engineer’s Estimates indicate that these pipelines will cost more than $1 5.8 million, which is currently appropriated; however, a better estimate will be possible once the major pipelines have gone to bid. WHEREAS, on March 5, 2002, by Resolution No. 2002-075, the City Council approved an agreement between the Encina Wastewater Authority and the City of Carlsbad for the design and construction of the Flow Equalization Joint Use Facilities; and WHEREAS, the Encina Wastewater Authority has completed the design of the Flow Equalization Joint Use Facilities, and has notified Carlsbad that its share of the project cost has increased to $3,936,000 and its percent share of the project cost has increased from 25 percent to 28.36 percent; and WHEREAS to be in compliance with the terms of the agreement, the appropriation for the woject will need to be increased from $2,970,000 to $3,936,000; and WHEREAS, there are excess funds in the amount of $2,827,500 from the appropriation for the Carlsbad Water Recycling Facility, Project No. 36753, and $966,000 of that excess is available to increase the appropriation for the Flow Equalization Joint Use Facilities, Project No. 3888 1 ; and WHEREAS, it is estimated that the Recycled Pipelines, Project No. 38871, will require 3dditional appropriations to complete the various pipelines; and WHEREAS, there are excess funds in the amount of $2,827,500 from the appropriation for he Carlsbad Water Recycling Facility, Project No. 36753, and $1,861,500 of that excess is available to increase the appropriation for the Recycled Pipelines, Project No. 38871. NOW THEREFORE BE IT RESOLVED by the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct.
