CITY MGR. PHASE II RECYCLED WATER TITLE XVI FUNDING PROGRAM IEPT. ENG RECOMMENDED ACTION: Adopt Resolution No. l2I6 approving an agreement with Olivenhain Municipal Water District for services to promote and support funding for Phase II Recycled Water Title XVI Funding Program. ITEM EXPLANATION : The Encina Basin Water Reclamation Program, Phase II Project (Phase II) has an estimated cost of $44 million. Phase II is being funded through three sources. The first source includes a loan and a $5 million grant from the California State Water Resources Control Board (SWRCB). The second source is a grant in the amount of $2,168,993 from the Environmental Protection Agency. The third is a grant authorized under Federal Bureau of Reclamation (BUREC) policy Title XVI of P.L. 102- 575, as amended by P.L. 104-266 for the North San Diego County Area (NSDCA) Water Recycling Project. The NSDCA Water Recycling Project is a cooperative effort that includes projects from four agencies including CMWD, Leucadia Wastewater District, Olivenhain Municipal Water District and San Elijo Joint Powers Authority. The BUREC funding is a 25 percent project grant having a maximum authorization of $20 million for all four-agency projects combined. Through fiscal year 2004, $12,991,000 in BUREC grant funds was appropriated by Congress for the NSDCA of which $4.7 million was allocated to the Phase II project. CMWD, along with Olivenhain Municipal Water District, is requesting that Congress appropriate an additional $6.0 million for fiscal year 2005 to assist in completing the project. To obtain this additional funding Olivenhain Municipal Water District obtained a proposal from the Furman Group in the amount not to exceed $70,000 for their lobbying services beginning July 2004. In previous fiscal years, all three of the other agencies have contracted with the Furman Group for assistance in promoting and supporting the funding for their Projects, which are described in the NSDCA Water Recycling Project. However, beginning this fiscal year only OMWD and CMWD require additional project funding; and therefore, only these two agencies will only share in the cost for services provided by the Furman Group. ENVIRONMENTAL REVIEW: The activities under this agreement are covered by the statutory exemption under Section 15282 of CEQA. FISCAL IMPACT: Status of Federal BUREC Fundinq: Carlsbad's Portion - The total cost of Carlsbad's portion of the Encina Basin Water Reclamation Program (Phase II) is estimated at $44 million; the full 25% reimbursement of these costs from the Federal Bureau of Reclamation (BUREC) would total $11 million. To date, $4.7 million has been allocated to the Carlsbad Municipal Water District by BUREC; an additional $6.0 million will be requested for a total of $10.7 million (shown in the table below). Based on these current estimates, approximately $300K would not be reimbursed by BUREC and would be funded by a State loan. Page 2 of Agenda Bill No. 571 Overall Proiect - The Federal Bureau of Reclamation (BUREC) grant reimburses 25% of the costs (less admin) of the recycled Phase II project up to a maximum of $20 million. To date, $13 million has been appropriated to the participating agencies as shown below. The remaining appropriation of $7.0 million will be divided between the Carlsbad Municipal Water District ($6 million) and the Olivenhain Municipal Water District ($1 million). These future appropriations are contingent upon Federal Congressional approvals and the expertise provided by the Furman Group to assist the City and OMWD in maximizing these Federal reimbursements. Aqreement for Lobbvinn Services: The annual agreement with Furman Group is for a not-to-exceed amount of $70,000; OMWD would pay 50% of the cost and CMWD would pay 50%. Funding would be obtained from the Water Operations Fund. EXHIBITS: 1. WHEREAS, the Board of Directors of Carlsbad Municipal Water District (CMWD) of the City of Carlsbad has previously appropriated funds for assistance in obtaining grants from Federal funding programs; and WHEREAS, the Carlsbad Municipal Water District has obtained approval to obtain a 25% project grant authorized under Bureau of Reclamation (BUREC) policy Title XVI of P.L. 102-575, as amended by P.L. 104-266 for the NOM San Diego County Area (NSDCA) Water Recycling Project; and WHEREAS, Olivenhain Municipal Water District has obtained a proposal from the Furman Group to provide assistance in promoting and supporting the obtaining of future appropriations for their Project and Carlsbad Municipal Water District’s Phase II Water Recycling Project; and WHEREAS, Olivenhain Municipal Water District has submitted an agreement to jointly share equally in the cost of the Furman Group expenses not to exceed $35,000 for each agency; and WHEREAS, there are sufficient Water Operations Funds appropriated for the services. NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal Water District (CMWD) of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the Carlsbad Municipal Water District authorizes the payment of up to $35,000 from the Water Operations Fund to the Olivenhain Municipal Water District for use in paying the Furman Group expenses. That the agreement with Olivenhain Municipal Water District for assistance in promoting and supporting the obtaining of future appropriations for each agency’s Projects, as described in the attached agreement, is hereby approved and the Mayor is hereby authorized and directed to execute said agreement.
