RECOMMENDED ACTION:
Adopt Resolution No. 1228 accepting the construction of the Carlsbad Water Recycling
Facility, Project No. 3675-2, as complete, and directing the City Clerk to record a Notice of
Completion and release bonds in accordance with State Law and City Ordinances.
ITEM EXPLANATION:
On May 14, 2002, PK Contractors, Inc. was awarded a contract in the amount of $8,723,859 for the
construction of the Carlsbad Water Recycling Facility, Project No. 3675-2.
PK Contractors, Inc. completed the water recycling facility on June 22, 2004. City staff has inspected
the work and found it to be satisfactory. Staff recommends formal acceptance of the facility by the
City Council.

RESOLUTION NO. 1228
A RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD
MUNICIPAL WATER DISTRICT (CMWD) ACCEPTING THE
CONSTRUCTION OF THE CARLSBAD WATER RECYCLING FACILITY, PROJECT NO. 3675-2.
WHEREAS, the construction of the Carlsbad Water Recycling Facility has been completed
:o the Carlsbad Municipal Water District’s satisfaction by PK Contractors, Inc. on June 22, 2004;
and
WHEREAS, the formal project Notice of Completion has been prepared; and
WHEREAS, all project costs have been established to date.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal
Water District (CMWD) of the City of Carlsbad, California, as follows:

That the above recitations are true and correct.
That the Carlsbad Water Recycling Facility, specifically identified as Project No.
3675-2, is deemed complete and is hereby accepted by the Board of Directors of the Carlsbad
Municipal Water District (CMWD).
3. That the Secretary of the Carlsbad Municipal Water District is hereby authorized
and directed to execute and record the Notice of Completion for the Carlsbad Water Recycling
Facility, Project No. 3675-2.
4. That the Secretary is directed to release all bonds on Project No. 3675-2 in
accordance with State Law and City Ordinances.
PASSED, APPROVED AND ADOPTED at a special meeting of the Carlsbad Municipal
Water District held on the 5th day of October , 2004 by the following vote, to wit:
