to quitclaim an existing easement agreement within the
ITEM EXPLANATION:
The Easement being quitclaimed was recorded in the office of the County Recorder on June 15,
1984 as document number 84-224556. The easement provided for access and pipelines to
Carlsbad Municipal Water District’s La Costa Hi reservoir.
As part of the Villages of La Costa-La Costa Ridge development, CT 99-04-02, the pipeline and
access have been rerouted. The re-aligned pipeline has been installed and new easements for
access have been granted to the City by the property owner, Real Estate Collateral Management
Company. The old easement is therefore no longer required.
ENVIRONMENTAL REVIEW:
The proposed quitclaim is exempt from environmental review under the California Environmental
Quality Act Section 15061 (b)(3), because it can be seen with certainty that there is no possibility that
the quitclaim may have a significant effect on the environment.
FISCAL IMPACT:
The original easement agreement was granted to the District for a no cost acquisition and the
District will quitclaim the easement for a no cost return to the property owners. The owners have
paid the standard fee for processing this quitclaim.

A RESOLUTION OF THE BOARD OF DIRECTORS OF
CARLSBAD MUNICIPAL WATER DISTRICT (CMWD) TO
QUITCLAIM AN EXISTING EASEMENT AGREEMENT WITHIN
02, PR 04-06.
THE VILLAGES OF LA COSTA-LA COSTA RIDGE, CT 99-04-
WHEREAS, an easement agreement for waterline and access purposes was granted to
Carlsbad Municipal Water District on June 15, 1984 as document number 84-224556; and
WHEREAS, a replacement access and waterline system has been constructed to serve
the La Costa Hi reservoir within the Villages of La Costa-La Costa Ridge development, CT 99-04-
02; and
WHEREAS, the original waterline system within the easement being quitclaimed has been
removed from service or relocated as a condition of development for CT 99-04-02; and
WHEREAS, Real Estate Collateral Management Company is the owner of the property
through which the original easement traverses; and
WHEREAS, the owner has submitted a request for quitclaim of the waterline easement
granted to Carlsbad Municipal Water District on June 15, 1984 as document number 84-224556
in the office of the San Diego County Recorder.; and
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal
Water District (CMWD) of the City of Carlsbad, California, as follows:

easement agreement within the Villages of La Costa-La Costa Ridge, CT 99-04-02, previously
recorded in the office of the San Diego County Recorder on June 15, 1984 as document number

authorized to release the original quitclaim deed to Real Estate Collateral Management Company,
LLC, a Delaware limited liability corporation.
PASSED, APPROVED AND ADOPTED at a special meeting of the Carlsbad Municipal
