ENG RE-ADVERTISE FOR BIDS FOR CONSTRUCTION OF REPLACEMENT, PROJECT NO. 3956, AND SAN MARCOS BOULEVARD WIDENING PROJECT RECOMMENDED ACTION: DEPTmHD7!iiF CITY ATTY. CITY MGR. Adopt Resolution No. 1257 to reject all bids, approve revised plans and specifications, and authorize the District Secretary to the Board to re-advertise for bids for the construction of the San Marcos Boulevard Widening Project and the San Marcos Boulevard Water Transmission Main Replacement, Project No. 3956. ITEM EXPLANATION: CONTRACTOR NAME The City of San Marcos has prepared plans and specifications to widen San Marcos Boulevard in the same reach as the San Marcos Boulevard Water Transmission Main. The joint construction under one contract of San Marcos Boulevard Widening and the San Marcos Boulevard Transmission Main is desirable and in the best interest of CMWD and the City of San Marcos. A construction agreement was approved on July 12, 2005 to provide for payment to Carlsbad Municipal Water District for the cost to construct and provide construction management and inspection for the roadway widening. CITYISTATE 1 LUMPSUM On July 12, 2005, the Board of Directors adopted Resolution No. 1252 approving the plans and specifications and authorizing the advertisement for bids for the construction of the San Marcos Boulevard Widening and the San Marcos Boulevard Water Transmission Main Replacement, Project No. 3956. The Engineer’s Estimate for the combined project was $3,918,892. On September 28, 2005, the Engineering Department received one (1) sealed bid as follows: 1 . Orion Construction Corporation San Marcos, CA $4,587,397 The work associated with San Marcos Boulevard Widening Project total was $2,063,727 or 36% higher than the Engineer’s Estimate, while the work associated with San Marcos Boulevard Water Transmission Main Replacement total was $2,523,670 or 4% higher than the Engineer’s Estimate. Staff has reviewed the bid package and found an unbalanced bid with very high unit prices for nine of the bid items associated with the road widening and mathematical errors on several bid items. The City of San Marcos has requested that all September 28 bids for the subject project be formally rejected by CMWD and the project advertised again as soon as possible. Because of these issues, staff recommends that the Board reject all bids received on September 28, 2005, as allowed by the provisions of California Public Contract Code Section 22038, and authorize the re-advertisement to receive new bids for the construction of the San Marcos Boulevard Widening Project and the San Marcos Boulevard Water Transmission Main Replacement, Project No. 3956. Staff intends to directly notify other experienced contractors located in Southern California of this project to develop more interest in providing bids. Staff has also incorporated comments received during the bid phase into the contract documents and requests the Board’s approval of a revised set of plans and specifications, including adjustments in bid quantities for the road widening, which are ready for bidding, and available for inspection at the Public Works Engineering Department. ENVIRONMENTAL REVIEW: The City of San Marcos is the lead agency for environmental review. A Mitigated Negative Declaration was prepared by the City of San Marcos in accordance with California Environmental Quality Act (CEQA) guidelines. The CMW D San Marcos Boulevard Water Transmission Main Replacement, Project No. 3956, was included in the Mitigated Negative Declaration for the widening project. Since the project is located within the City of San Marcos, the City of Carlsbad does not have regulatory jurisdiction. The cost to reject bids, make minor revisions to the contract documents and re-advertise for bids is considered to be insignificant relative to the construction cost. Reproduction costs for bid packages will be offset by bidder's payment for the bid packages. The total cost of constructing the San Marcos Boulevard Widening Project is shown in Table 2. The estimated cost for the construction of the San Marcos Boulevard Widening Project is $1,842,892, and will be funded by the City of San Marcos. AND AUTHORIZATION TO RE-ADVERTISE FOR BIDS FOR WHEREAS, the Board of Directors of the CMWD has previously approved the plans and specifications and authorized the advertisement for bids for the construction of the San Marcos Boulevard Widening and Water Transmission Main, Project No. 3956; and WHEREAS, one (1) sealed bid was received on September 28, 2005 by the City of Carlsbad for the construction of the San Marcos Boulevard Widening and Water Transmission Main, Project No. 3956, and were subsequently reviewed by staff; and WHEREAS, CMWD hereby finds it necessary, desirable, and in the public interest to follow the provisions of California Public Contracts Code, Section 22038, whereby the CMWD, in its discretion, may reject all bids and elect, in its further discretion, to seek new bids for this project; and WHEREAS, the plans and specifications for the construction of the San Marcos Boulevard Widening and Water Transmission Main, Project No. 3956, have been prepared and are on file in the Public Works-Engineering Department of the City of Carlsbad and are incorporated by reference herein; and WHEREAS, there are sufficient funds available to construct the project, from the Water Replacement Fund; and NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal Water District (CMWD) of the City of Carlsbad, California, as follows: 1. 2.
