RECOMMENDED ACTION:
Adopt Resolution No. 1273 accepting the construction contract on the El Camino Real
Domestic Water and Recycled Water Transmission Mains, Project Nos. 3446 and 3887-H as complete,
and directing the Secretary to record a Notice of Completion and release bonds in accordance with State
Law and City Ordinances.
ITEM EXPLANATION:
On September 14, 2004, Cass Construction, Inc. was awarded a contract in the amount of $3,392,703
for the construction of the El Camino Real Domestic Water and Recycled Water Transmission Mains,
Project Nos. 3446 and 3887-H. On June 7, 2005, Council awarded an additional $324,433 for pavement
repairs on El Camino Real as part of this project.
Cass Construction, Inc. substantially completed the work on February 3, 2006. Final contract, change
order, and administrative requirements were completed on April 28, 2006. City staff has inspected the
work and found it to be satisfactory. Staff recommends formal acceptance of the improvements by the
Board.
ENVIRONMENTAL REVIEW:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements of
CEQA pursuant to Section 15268 of the State CEQA Guidelines.

A RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD
MUNICIPAL WATER DISTRICT (CMWD) ACCEPTING THE
CONSTRUCTION CONTRACT ON THE EL CAMINO REAL DOMESTIC
WATER AND RECYCLED WATER TRANSMISSION MAINS, PROJECT
NOS. 3446 AND 3887-H.
WHEREAS, the construction of the El Camino Real Domestic Water and Recycled Water
Transmission Mains has been completed to the Carlsbad Municipal Water District's satisfaction by
Cass Construction, Inc. on February 3, 2006; and
WHEREAS, the formal project Notice of Completion has been prepared; and
WHEREAS, all project costs have been established to date.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal
Water District (CMWD) of the City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the El Camino Real Domestic Water and Recycled Water Transmission
Mains, specifically identified as Project Nos. 3446 and 3887-H, is deemed complete and is hereby
accepted by the Board of Directors of Carlsbad Municipal Water District of the City of Carlsbad,
California.
3. The Secretary of the Carlsbad Municipal Water District is hereby authorized and
directed to execute and record the Notice of Completion for the El Camino Real Domestic Water
and Recycled Water Transmission Mains, Project Nos. 3446 and 3887-H.
PASSED, APPROVED AND ADOPTED at a special meeting of the Carlsbad Municipal
Water District held on the 13th day of June , 2006 by the following vote, to wit:
