RECOMMENDED ACTION:
Adopt Resolution No.1281 accepting the construction contract on the Twin D Recycled
Water Pump Station for the Encina Basin Water Reclamation Program, Phase II, Project No. 3889(A)
as complete, and directing the City Clerk to record a Notice of Completion and release bonds in
accordance with State Law and City Ordinances.
ITEM EXPLANATION:
On June 8, 2004, SCW Contracting was awarded a contract in the amount of $1,493,000 for the Twin
D Recycled Water Pump Station for the Encina Basin Water Reclamation Program, Phase II, Project
No. 3889(A).
On June 23, 2006 SCW Contracting substantially completed the pump station improvements. The
final project change order was fully executed on September 11, 2006. City staff has inspected the
work and found it to be satisfactory. Staff recommends formal acceptance of the improvements by the
Board.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements
of CEQA pursuant to Section 15268 of the State CEQA Guidelines.

A RESOLUTION OF THE BOARD OF DIRECTORS OF
3 CARLSBAD MUNICIPAL WATER DISTRICT (CMWD),
ACCEPTING THE CONSTRUCTION CONTRACT ON THE TWIN
4 D RECYCLED WATER PUMP STATION FOR THE ENCINA
BASIN WATER RECLAMATION PROGRAM, PHASE II,
5 PROJECT NO. 3889(A) ._
6 WHEREAS, the construction of the Twin D Recycled Water Pump Station for the Encina
7 Basin Water Reclamation Program, Phase II has been completed to the Carlsbad Municipal
8 Water District's satisfaction by SCW Contracting on September 11, 2006; and
9 WHEREAS, the formal project Notice of Completion has been prepared; and
10 WHEREAS, all project costs have been established to date.

NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Carlsbad

Municipal Water District of the City of Carlsbad, California, as follows:

1. That the above recitations are true and correct.

2. That the Twin D Recycled Water Pump Station for the Encina Basin Water

Reclamation Program, Phase II, specifically identified as Project No. 3889(A), is deemed16
complete and is hereby accepted by the Board of Directors of the Carlsbad Municipal Water
District of the City of Carlsbad.18
