ENG AUTHORIZATION TO ADVERTISE FOR BIDS FOR LAKE CALAVERA REMEDIAL IMPROVEMENTS PROJECT NO. 38211 DEPT. HEAD CITY ATTY. CITY MGR. RECOMMENDED ACTION: Adopt Resolution No. 1283 approving plans and specifications and authorizing the District Secretary to the Board to advertise for bids for Lake Calavera Remedial Improvements, Project No. 38211. ITEM EXPLANATION: The Calavera Dam is an earth-fill dam that impounds waters from the Calavera Creek watershed to form the Lake Calavera reservoir. At present, the Calavera Dam's outlet works are inoperable and are in need of remedial improvements. The Lake Calavera Remedial Improvements Project will restore operational control of the dam and make necessary remedial facility repairs while modernizing the reservoir operations. The plans and specifications for the Lake Calavera Remedial Improvements have been completed and include the following improvements: • Removal of the upper 26-feet of the existing outlet control tower and replacement with an outlet valve system placed upon the lakeside face of the dam • Slip-lining repair to the outlet pipe underneath the dam • Construction of an on-site control building • Improvements to the spillway apron and channel • Extension of a small access road to the spillway apron • Improvements to the dam crest for maintenance crew access As part of the project, the upper twenty-six feet of the outlet control tower will be removed and replaced with an outlet control system that is placed upon the lakeside face of the dam. The inoperable manually-operated control system will be replaced with a dual action hydraulically and pneumatically-controlled outlet valve control system. This redundancy is required to ensure a safe and reliable operational control of the valves. The valve controls will be housed within the newly constructed on-site control building. During the environmental permitting process, a number of project changes were required, and have been incorporated into the improvement project. Among the significant design changes included is the use of: ArmorFlex block within the spillway channel; colored concrete at the spillway channel and apron; motion-sensor control building security lighting; and a construction method that does not require a significant water level draw down to facilitate replacement of the inoperable valves. The use of the ArmorFlex block within the spillway channel is an environmental benefit since the block has an opening that allows for plant growth and water infiltration. On January 23, 2006, an appellant filed a timely request for appeal of the HMPP for the project to the City Council. On January 27, 2006, the appellant amended the appeal form on file with the City Clerk. The appeal was denied by the City Council on April 18, 2006, thereby upholding the Planning Commission's decision to approve the HMPP by City Council Resolution No. 2006-101. In addition to these environmental documents, the following additional permits have been acquired for construction of the project: 1. California Regional Water Quality Control Board 401 Water Quality Certification and Waiver issued 5/15/2006 and amended 8/11/2006. 2. California Department of Fish and Game Agreement Regarding Proposed Stream or Lake Alteration pursuant to Section 1602 of the California Fish and Game Code. 3. Department of the Army Nationwide Permit (NWP) 3 and 33 issued on 11/6/2006. FISCAL IMPACT: The Engineer's Estimate for the cost to construct the Lake Calavera Remedial Improvements Project is as shown below in Table 1. Gerwick Inc. and has been reviewed by the City's engineering staff. Ben C. Gerwick prepared the design and cost estimate for the unique construction approach not requiring water level draw down to facilitate construction while HDR Engineering prepared the design and cost estimate for the balance of remedial improvements. Based on the updated Engineer's Estimate reflecting the current cost conditions, the project costs now exceed the current appropriation. Since being last updated, construction material costs for electrical and mechanical equipment, steel, copper, and concrete have dramatically increased. In particular mechanical equipment, stainless steel, high density polyethylene pipe, concrete, and aluminum have significantly increased and considerably outpaced the standard Engineer News Record Construction Cost Index (ENR CCI) by a range of 25% to 100%. Also contributing to the construction cost increase PageS are design changes resulting from the environmental permitting process. The following are some of the specific factors causing the increased construction cost: • Use of the ArmorFlex block within the spillway requires increased channel excavation and its use is approximately twice the cost of using conventional shot-crete lining • Use of colored concrete increases unit cost of concrete • Spillway earthwork quantities have changed due to the damage resulting from previous storm water flows within the spillway channel The total project cost is estimated at $6,100,000 for the construction and mitigation program of the Lake Calavera Remedial Improvements Project and is being funded by the Water Replacement Fund. An additional appropriation of $2,882,400 is anticipated to complete the project. A request for an additional appropriation is not being sought at this time, but is anticipated at the time of award of the construction contract. The additional appropriation will be based upon actual contractual costs. Sufficient funds are available for the additional appropriation when requested at the time of award of the construction contract. The Lake Calavera Remedial Improvements Project will restore operational control and safety of the dam while also restoring compliance with the requirements of the California Department of Water Resources Division of Safety of Dams (DSOD). Because of the need to restore compliance with the DSOD, specific requirements have been incorporated into the project, and there is no option to redesign this project to be within the current appropriation. CARLSBAD ENGINEERING DEPT.7/29/02 H:\CAPITAL IMPROVEMENT PROGRAU\3821 LAKE CALAVERA IUPROVEMENTS\PIANS&EXHIB1TS\PLANS\CALAVERA DAM.DWG 1 RESOLUTION NO. 1283 2 A RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD 3 MUNICIPAL WATER DISTRICT (CMWD), APPROVING PLANS AND SPECIFICATIONS AND AUTHORIZING THE DISTRICT 4 SECRETARY TO ADVERTISE FOR BIDS FOR LAKE CALAVERA REMEDIAL IMPROVEMENTS, PROJECT NO. 38211, AND 5 APPROPRIATION OF FUNDS. 6 WHEREAS, the Board of Directors of Carlsbad Municipal Water District has determined 7 it necessary, desirable, and in the public interest to construct Lake Calavera Remedial 8 Improvements, Project No. 38211; and 9 WHEREAS, the plans and specifications for furnishing of all labor, materials, tools, 10 equipment, transportation, and other expenses necessary or incidental to said project have been 11 prepared and are on file in the Engineering Department of the City of Carlsbad and are 12 incorporated by reference herein; and 13 WHEREAS, the estimated project costs for the Lake Calavera Remedial Improvements 14 Project is $6,100,000; and 15 WHEREAS, the appropriation totaling $3,217,600 for the Lake Calavera Remedial 16 Improvements Project is insufficient to complete the project; 17 WHERAS, additional funds in the amount of $2,882,400 are anticipated to be needed to 18 complete the project and will be requested at time of award of construction contract; and 19 WHEREAS, a Mitigated Negative Declaration has been adopted by the Planning 20 Commission by Resolution No. 5890, dated January 18, 2006, as required by the California 21 Environmental Quality Act; and 22 WHEREAS, the Planning Commission approved a Conditional Use Permit (CUP 04-11) 23 on January 18, 2006 by Planning Commission Resolution No. 5891; and 24 WHEREAS, the Planning Commission approved a Habitat Management Plan Permit 25 (HMPP 05-03) on January 18, 2006 by Planning Commission Resolution No. 5892; and 26 WHEREAS, an appellant filed a timely appeal of HMPP 05-03 on January 23, 2006 and 2^ later amended the appeal on January 27, 2006; and 28 1 WHEREAS, upon hearing the appeal, the City Council upheld the findings and conditions 2 of Planning Commission Resolution No. 5892 by City Council Resolution No. 2006-101 on 3 April 18, 2006; and 4 WHEREAS, the project has received the necessary environmental permits from the 5 California Regional Water Quality Control Board and the Department of the Army and an 6 agreement from the California Department of Fish and Game to conduct the improvements. 7 NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal 8 Water District as follows: 9 1. That the above recitations are true and correct. 10 2. That the plans, specifications, and contract documents, on file in the 11 City Engineer's office as described above for the Lake Calavera Remedial Improvement Project, 12 Project No. 38211, are hereby approved. 13 3.
