' ($!> CITYMGR. 4£> RECOMMENDED ACTION: Adopt Resolution No. 1298 approving and authorizing an increase in appropriations for the San Marcos Boulevard Widening, Project No. 6005. ITEM EXPLANATION: It was discovered during construction that a portion of the proposed median on San Marcos Boulevard had to be redesigned and additional pavement removal and replacement quantities and facility relocations were needed at the intersection of San Marcos Boulevard and Rancho Santa Fe Road. The redesign work was completed by San Marcos and a construction change order proposal was obtained from the contractor. The additional unforeseen work requires additional funds to be appropriated for the San Marcos Boulevard Widening in the amount of $250,000. This results in a need to increase the contingency for the San Marcos Boulevard Widening portion of the construction contract from $459,423 to $709,423. In accordance with Section I B7 of the agreement with the City of San Marcos, the Public Works Director for the City of San Marcos has reviewed and approved the change order work and concurs in increasing the project's contingency by $250,000 (see attached letter). The contingency increase of $250,000 results in a need to increase the total appropriation for the street widening portion of the project, Project No. 6005, from $2,734,147 to $2,984,147 (Table 1). All funds allocated and expended for the construction of the roadway work will be reimbursed by the City of San Marcos under the existing agreement between the District and City of San Marcos. ENVIRONMENTAL IMPACT: The City of San Marcos is the lead agency for environmental review. A Mitigated Negative Declaration was prepared by the City of San Marcos in accordance with California Environmental Quality Act (CEQA) guidelines. The CMWD San Marcos Boulevard Water Transmission Main Replacement, Project No. 3956, was included in the Mitigated Negative Declaration for the widening project. Since the project is located within the City of San Marcos, the City of Carlsbad does not have regulatory jurisdiction. FOR CITY CLERKS USE ONLY. This table reflects increasing the construction contingency budget by $250,000 and results in a need to increase the appropriation for Project No. 6005 by $250,000. WHEREAS, a funding and administration agreement was approved by Resolution No. 1252, dated July 15, 2005, between the City of San Marcos and CMWD for the San Marcos Transmission Main Replacement, and the San Marcos Boulevard Widening Project; and WHEREAS, on January 17, 2006, by Resolution No. 1267, the Board of Directors of the Carlsbad Municipal Water District awarded the construction contract for the San Marcos Transmission Main Replacement, Project No. 3956, and the San Marcos Boulevard Widening, Project No. 6005; and WHEREAS, on April 3, 2007, an increase to the construction contingency of the San Marcos Boulevard Widening, Project No. 6005, was approved by the Public Works Director of 14 the City of San Marcos and approved by the Carlsbad Municipal Water District pursuant to 15 Resolution 1295; and WHEREAS, it is been determined once again to be necessary to increase construction contingency of the San Marcos Boulevard Widening, Project No. 6005, by an amount of 18 $250,000, which has been approved by the Public Works Director of the City of San Marcos; and 19 WHEREAS, it is therefore necessary to increase the total appropriation for the San Marcos 20 Boulevard Widening, Project No. 6005, by an amount of $250,000. 21 NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal 22 Water District (CMWD) of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the contingency for construction of the San Marcos Boulevard Widening, Project No. 6005, shall be increased by $250,000 and the Executive Manager is hereby authorized to approve construction change orders up to $709,423 for Project No. 6005. 3. TRANSMISSION MAIN AND ROAD IMPROVEMENTS CMWD PROJECT NO. 3956 AND COSM CIP NO. 274 INCREASE TO COSM CONSTRUCTION CONTINGENCY Dear Bill, I have reviewed the PCO items No. 36, 37, 38, 39, 41, 42, and items described as "1st Delay Claim", "Construction Mgmt." and "Striping Revisions" in Change Order No.6 to the Fletcher Creamer and Sons contract. Per the reimbursement agreement dated July 15, 2005, Section 1B7, I authorize the construction contingency to be increased by $250,000.00 (two hundred fifty thousand dollars and no cents).
