CONSTRUCTION OF THE ENCINA BASIN WATER
RECLAMATION PROGRAM, PHASE II, BRESSI
RECYCLED AND POTABLE WATER PUMP

RECOMMENDED ACTION:
Adopt Resolution No. 131°.accepting the contract for construction of the Encina Basin
Water Reclamation Program, Phase II, Bressi Recycled and Potable Water Pump Stations, Project
Nos. 3889 and 3910 as complete, and directing the Secretary to record a Notice of Completion and
release bonds in accordance with State Law and City Ordinances.
ITEM EXPLANATION:
On January 18, 2005 Orion Construction Corporation (Orion) was awarded a contract in the amount of
$2,397,500 for the construction of the Encina Basin Water Reclamation Program, Phase II, Bressi
Recycled and Potable Water Pump Stations, Project Nos. 3889 and 3910.
Orion substantially completed the work on September 28, 2007. The punch list work was completed and
the final change order was executed on October 12, 2007. Staff has inspected the work and found it to
be satisfactory. Staff recommends formal acceptance of the improvements by the Board.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements of
CEQA pursuant to Section 15268 of the State CEQA Guidelines.

WHEREAS, the construction of the Encina Basin Water Reclamation Program, Phase II,

Bressi Recycled and Potable Water Pump Stations has been completed to the Carlsbad
Municipal Water District's satisfaction by Orion Construction Corporation on October 12, 2007;

and
9
WHEREAS, the formal project Notice of Completion has been prepared; and
10
WHEREAS, all project costs have been established to date.11
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal
Water District (CMWD) of the City of Carlsbad, California, as follows:

14 1. That the above recitations are true and correct.
15 2. That the Encina Basin Water Reclamation Program, Phase II, Bressi Recycled and
16 Potable Water Pump Stations, specifically identified as Project Nos. 3889 and 3910, is deemed
17 complete and is hereby accepted by the Board of Directors of Carlsbad Municipal Water District
18 of the City of Carlsbad, California.
19 3. The Secretary of the Carlsbad Municipal Water District is hereby authorized and
20 directed to execute and record the Notice of Completion for the Encina Basin Water Reclamation
21 Program, Phase II, Bressi Recycled and Potable Water Pump Stations, Project Nos. 3889 and
22 3910.
