NOTICE OF COMPLETION OF CONTRACT FOR
CONSTRUCTION OF THE MAHR RESERVOIR
IMPROVEMENTS, PROJECT NO. 3890

RECOMMENDED ACTION:
Adopt Resolution No.1311 _accepting the contract for construction of the Mahr Reservoir
Improvements, Project No. 3890 as complete, and directing the Secretary to record a Notice of
Completion and release bonds in accordance with State Law and City Ordinances.
ITEM EXPLANATION:
On October 18, 2005, Orion Construction Corporation was awarded a contract in the amount of
$2,447,975 for the Mahr Reservoir Improvements, Project No. 3890.
Orion Construction Corporation completed the reservoir work on July 29, 2007. The final punch list
work was completed on August 29, 2007. City staff has inspected the work and found it to be
satisfactory. Staff recommends formal acceptance of the improvements by the Board.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements
of CEQA pursuant to Section 15268 of the State CEQA Guidelines.

WHEREAS, the construction of the Mahr Reservoir Improvements was substantially
5
completed by Orion Construction Corporation on July 29, 2007 and punch list work was
6
completed on August 29, 2007; and
7
WHEREAS, the formal project Notice of Completion has been prepared; and
8
WHEREAS, all project costs have been established to date.

NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal

Water District (CMWD) of the City of Carlsbad, California, as follows:
.» 1. That the above recitations are true and correct.
13 2. That the Mahr Reservoir Improvements, specifically identified as Project No. 3890,
14 is deemed complete and is hereby accepted by the Board of Directors of Carlsbad Municipal
15 Water District of the City of Carlsbad, California.
16 3. The Secretary of the Carlsbad Municipal Water District is hereby authorized and
17 directed to execute and record the Notice of Completion for the Mahr Reservoir Improvements,
18 Project No. 3890.
