NOTICE OF COMPLETION OF CONTRACT FOR
CONSTRUCTION OF THE SAN MARCOS BOULEVARD
WATER TRANSMISSION PIPELINE REPLACEMENT,
PROJECT NO. 3956, AND THE SAN MARCOS BOULEVARD
WIDENING, PROJECT NO. 6005

RECOMMENDED ACTION:
Adopt Resolution No. 1315 accepting the contract for construction of the San Marcos
Boulevard Water Transmission Pipeline Replacement, Project No. 3956, and the San Marcos
Boulevard Widening, Project No. 6005, as complete, and directing the Secretary to record a Notice of
Completion and release bonds in accordance with State Law and City Ordinances.
ITEM EXPLANATION:
On July 15, 2005 the Carlsbad Municipal Water District and the City of San Marcos entered into an
agreement for the construction of widening a portion of San Marcos Boulevard and San Marcos
Boulevard water transmission main. The agreement outlined the responsibilities of each agency and
established funding mechanisms for completing the desired construction projects.
On January 17, 2006, J. Fletcher Creamer & Son, Inc. was awarded a contract in the amount of
$4,348,237.50 for the construction of both projects. The San Marcos Boulevard Water Transmission
Pipeline Replacement portion of the contract was $2,254,005 and was funded by the Carlsbad
Municipal Water District. The San Marcos Boulevard Widening portion of the contract was
approximately $2,094,232 and was funded by the City of San Marcos.
J. Fletcher Creamer & Son, Inc. substantially completed the contract work on August 10, 2007. The
final punch list work was completed concurrently with the required landscape maintenance period,
which terminated on December 7, 2007. City of Carlsbad and City of San Marcos staff have inspected
the work and found it to be satisfactory. Staff recommends formal acceptance of the improvements by
the Board.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements
of CEQA pursuant to Section 15268 of the State CEQA Guidelines.

5 WHEREAS, the construction of the San Marcos Boulevard Water Transmission Pipeline

Replacement, Project No. 3956, and the San Marcos Boulevard Widening, Project No. 6005 was
' substantially completed on August 10, 2007, and all punch list work was completed concurrently
8 with the conclusion of the required landscape maintenance period on December 7, 2007; and
9 WHEREAS, all work has been completed to the Carlsbad Municipal Water District's
10 satisfaction by J. Fletcher Creamer & Son, Inc.; and
1 ^ WHEREAS, the formal project Notice of Completion has been prepared; and
12 WHEREAS, all project costs have been established to date.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipaln o
Water District (CMWD) of the City of Carlsbad, California, as follows:

1. That the above recitations are true and correct.
15 2. That the contract for the construction of the San Marcos Boulevard Water

Transmission Pipeline Replacement, specifically identified as Project No. 3956, and the San Marcos
17
Boulevard Widening, specifically identified as Project No. 6005, is deemed complete and is hereby
18
accepted by the Board of Directors of Carlsbad Municipal Water District.

3. The Secretary of the Board is hereby authorized and directed to execute and
20 record the Notice of Completion for the San Marcos Boulevard Water Transmission Pipeline
21 Replacement, Project No. 3956, and the San Marcos Boulevard Widening, Project No. 6005.
