RECOMMENDED ACTION:
Adopt Resolution No. 1317 accepting the contract for construction of the El Camino Real
Potable Water System Projects, Project Nos. 38441, 39111, 39151, 50021, and 50031, as complete,
and directing the Secretary to record a Notice of Completion and release bonds in accordance with
State Law and City Ordinances.
ITEM EXPLANATION:
On November 7, 2006, J. Fletcher Creamer & Son, Inc. was awarded a contract in the amount of
$1,873,050 for the construction of the El Camino Real Potable Water System Projects,
Project Nos. 38441, 39111, 39151, 50021, and 50031.
J. Fletcher Creamer & Son, Inc. substantially completed the contract work on October 3, 2007. The
final punch list work was completed on March 1, 2008. Staff has inspected the work and found it to be
satisfactory. Staff recommends formal acceptance of the improvements by the Board.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements
of CEQA pursuant to Section 15268 of the State CEQA Guidelines.

5 WHEREAS, the construction of the El Camino Real Potable Water System Projects,
6 Project Nos. 38441, 39111, 39151, 50021, and 50031, was substantially completed on
October 3, 2007, and all punch list work was completed on March 1 , 2008; and
WHEREAS, all work has been completed to the Carlsbad Municipal Water District's

satisfaction by J. Fletcher Creamer & Son, Inc.; and

WHEREAS, the formal project Notice of Completion has been prepared; and
10 WHEREAS, all project costs have been established to date.
1 1 NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal
1 2 Water District (CMWD) of the City of Carlsbad, California, as follows:
13 1 . That the above recitations are true and correct.
14 2. That the contract for the construction of the El Camino Real Potable Water System
15 Projects, Project Nos. 38441, 39111, 39151, 50021, and 50031, is deemed complete and is hereby
16 accepted by the Board of Directors of Carlsbad Municipal Water District.
17 3. The Secretary of the Board is hereby authorized and directed to execute and
18 record the Notice of Completion for the El Camino Real Potable Water System Projects,
1 9 Project Nos. 38441 , 391 1 1 , 391 51 , 50021 , and 50031 .
