RECOMMENDED ACTION:
Adopt Resolution No. 1326 accepting the contract for construction of the Aviara
Community Park Fire and Water Service Relocation Project, Project No. 3699-W, as complete and
directing the Secretary to record a Notice of Completion and release bonds in accordance with State
Law and City Ordinances.
ITEM EXPLANATION:
On August 7, 2007, the Carlsbad Municipal Water District and Zondiros Corporation entered into a
contract in the amount of $53,500 for the construction of the Aviara Community Park Fire and Water
Service Relocation project, Project No. 3699-W.
Zondiros Corporation completed the contract work on March 26, 2008. City staff has inspected the
work and found it to be satisfactory. Staff recommends acceptance of the improvements by the Board.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements
of CEQA pursuant to Section 15268 of the State CEQA Guidelines.

RESOLUTION NO. 1326
A RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD
MUNICIPAL WATER DISTRICT (CMWD) ACCEPTING THE
CONTRACT FOR CONSTRUCTION OF THE AVIARA COMMUNITY
PARK FIRE AND WATER SERVICE RELOCATION, PROJECT
NO. 3699-W. AS COMPLETE.
WHEREAS, the construction of the Aviara Community Park Fire and Water Service
Relocation project has been completed to the Carlsbad Municipal Water District's satisfaction by
Zondiros Corporation on March 26, 2008; and
WHEREAS, the formal project Notice of Completion has been prepared; and
WHEREAS, all project costs have been established to date.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal
Water District (CMWD) of the City of Carlsbad, California, as follows:
1 . That the above recitations are true and correct.
2. That the Aviara Community Park Fire and Water Service Relocation project,
specifically identified as Project No. 3699-W, is deemed complete and is hereby accepted by the
Board of Directors of Carlsbad Municipal Water District.
3. The Secretary of the Board is hereby authorized and directed to execute and
record the Notice of Completion for the Aviara Community Park Fire and Water
Relocation project, Project No. 3699-W.
