NOTICE OF COMPLETION OF CONTRACT FOR THE
CONSTRUCTION OF THE RESERVOIR FENCING
PROJECT FOR "E" TANK, "TAP" RESERVOIR, "SANTA
FE II" AND "LA COSTA LO" TANK, PROJECT NO. 3822

RECOMMENDED ACTION:
Adopt Resolution No. 1342 accepting the contract for the Reservoir Fencing Project for "E"
Tank, "Tap" Reservoir, "Santa Fe II" and "La Costa Lo" Tank, Project No. 3822, as complete, and
directing the Secretary to record a Notice of Completion and release bonds in accordance with State
Law and City Ordinances.
ITEM EXPLANATION:
On April 4, 2008, the Carlsbad Municipal Water District and Scott Fence entered into a contract in the
amount of $83,920.00 for the Reservoir Fencing Project for "E" Tank, "Tap" Reservoir, "Santa Fe II"
and "La Costa Lo" Tank, Project No. 3822.
Scott Fence completed the contract work on August 5, 2008. Staff has inspected the work and found it
to be satisfactory. Staff recommends formal acceptance of the improvements by the Board.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements
of CEQA pursuant to Section 15268 of the State CEQA Guidelines.

3 CARLSBAD MUNICIPAL WATER DISTRICT (CMWD)
ACCEPTING THE CONTRACT FOR THE CONSTRUCTION OF
4 THE RESERVOIR FENCING PROJECT FOR "E" TANK, "TAP"
RESERVOIR, "SANTA FE II" AND "LA COSTA LO" TANK,
5 PROJECT NO. 3822

WHEREAS, the Reservoir Fencing Project for "E" Tank, "Tap" Reservoir, "Santa Fe II" and
7 "La Costa Lo" Tank, Project No. 3822 was completed on August 5, 2008; and
8 WHEREAS, all work has been completed to the Carlsbad Municipal Water District's
9 satisfaction by Scott Fence; and
10 WHEREAS, the formal project Notice of Completion has been prepared; and
-I -j WHEREAS, all project costs have been established to date.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal
Water District (CMWD) of the City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.

2. That the contract for the Reservoir Fencing Project for "E" Tank, "Tap" Reservoir,

"Santa Fe II" and "La Costa Lo" Tank, Project No. 3822, is deemed complete and is hereby

accepted by the Board of Directors of Carlsbad Municipal Water District.

3. The Secretary of the Board is hereby authorized and directed to execute and
18
record the Notice of Completion for the Reservoir Fencing Project for "E" Tank, "Tap" Reservoir,
19 "Santa Fe II" and "La Costa Lo" Tank, Project No. 3822.
