PW-M&O DECLARATION OF TERMINATION OF LOCAL EMERGENCY FOR REPAIR OF A RECYCLED WATER LINE BREAK ON PALOMAR AIRPORT ROAD DEPT. HEAD /] CITY ATTY. CITY MGR. RECOMMENDED ACTION: Carlsbad Municipal Water District Board of Directors Adopt Resolution No. 1357 terminating the Local State of Emergency, declaring that the emergency has been abated and appropriate additional funds to the Recycled Water Operating budget to pay for the repairs. ITEM EXPLANATION: On March 10, 2009 the Executive Manager of the Carlsbad Municipal Water District declared a Local Emergency to complete urgent repair work on a 27" recycled waterline break crossing the three East bound lanes of Palomar Airport Road, approximately 500' East of El Camino Real, in Carlsbad. Current law requires that a report be provided every two weeks on the status of the emergency. This action is to retroactively cover the report period up to March 31, 2009 as well as to terminate the local declaration of emergency, effective May 12, 2009. FISCAL IMPACT: The cost of the repair is $95,165 and there are no additional costs anticipated with this event. Staff is requesting an additional appropriation of $95,165 from the Recycled Water fund balance to pay for the repairs. Sufficient funds are available. ENVIRONMENTAL IMPACT: Emergency projects are statutorily exempt from CEQA pursuant to CEQA Guidelines section 15269. EXHIBITS: 1. That the above recitations are true and correct. 21 2. This resolution is effective to cover the reporting period from up to March 31, 2009 22 nunc pro tune. 23 3. The declaration of emergency is hereby terminated according to State law. 24 4.
