[JJ^ RECOMMENDED ACTION: Adopt Resolution No. 1367 accepting bids and awarding the contract to Atlas Allied, Inc for construction of the Industrial Park Recycled Water Service Lines Project No. 5201. ITEM EXPLANATION: The Industrial Park Recycled Water Service Lines Project will construct and connect copper service lines to two (2) residential and fourteen (14) industrial sites from the Districts recycled water pipelines at the locations shown in Exhibit 1. The project will allow conversion of onsite irrigation systems from potable water to recycled water. This project will install three (3) new 1-inch recycled water service lines and thirteen (13) new 2-inch recycled water service lines. Converting the sixteen (16) sites shown on Exhibit 1 to recycled water for irrigating the landscaping is projected to reduce the demand on Carlsbad's potable water system by ten (10) million gallons per year. The second lowest bidder, Atlas Allied, Inc., was determined to be responsive after staff has completed review of the contract documents and determined that they were in order. Staff recommends awarding the construction contract to Atlas Allied, Inc. in the amount of $159,500. ENVIRONMENTAL IMPACT: This project is categorically exempt from the environmental review process under Section 15302(c) of Title 14 of the California Code of Regulations. CARLSBAD ENGINEERING DEPT. 7/07/09 &\CAPITAL\t.OCA'nON UAPS\5201.DWG 1 RESOLUTION NO. 1367_ 2 A RESOLUTION OF THE CARLSBAD MUNICIPAL WATER 3 DISTRICT, ACCEPTING BIDS AND AWARDING A CONTRACT FOR THE INDUSTRIAL PARK RECYCLED WATER SERVICE 4 LINES PROJECT NO. 5201. 5 WHEREAS, the Board of Directors of the Carlsbad Municipal Water District has 6 determined it necessary, desirable, and in the public interest to construct the Industrial Park 7 Recycled Water Service Lines, Project No. 5201; and 8 WHEREAS, on May 5, 2009, the Board of Directors of Carlsbad Municipal Water, 9 Resolution No. 1351, has previously approved plans for construction of the Industrial Park 10 Recycled Water Service Lines Project No. 5201; and 11 WHEREAS, twelve (12) sealed bids were received on June 30, 2009 by the District for 12 the construction of said project; and 13 WHEREAS, the lowest responsive and responsible bid to construct said project was 14 submitted by Atlas Allied, Inc. in the amount of $159,500; and 15 WHEREAS, there are sufficient funds currently appropriated for Project No. 5201 to 16 complete the project; and 17 WHEREAS, subsection 3.28.040(C)(6) of the Carlsbad Municipal Code authorizes the 18 Executive Manager to approve change orders in the amount equal to the contingency set at the 19 time of project award. 20 NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Carlsbad 21 Municipal Water District, as follows: 22 1. That the above recitations are true and correct. 23 2. That the low bid of $159,500 submitted by Atlas Allied, Inc., for the construction24 of the Industrial Park Recycled Water Service Lines Project No. 5201, is accepted and the25 President is hereby authorized to execute a contract with Atlas Allied, Inc. for Project No. 5201.26 3. That the award of this contract is contingent upon the bidder submitting the lowest responsible bid executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within twenty (20) days of adoption of this resolution.
