RECOMMENDED ACTION:
Adopt Resolution No. 1379 accepting the contract for construction of the Mitigation
Landscape Improvements, Lake Calavera Remedial Improvements, Project No. 38211-A, as
complete, and directing the Secretary to record a Notice of Completion and release bonds in
accordance with State Law and City Ordinances.
ITEM EXPLANATION:
On October 7, 2008, LCG Corporation dba LCG Landscape was awarded a contract in the amount of
$191,797 for the construction of the Mitigation Landscape Improvements, Lake Calavera Remedial
Improvements, Project No. 38211-A.
LCG Landscape completed the contract work on May 21, 2009. Staff has inspected the work and
found it to be satisfactory. The required 120 day maintenance period has elapsed and staff
recommends formal acceptance of the improvements by the Board.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements
of CEQA pursuant to Section 15268 of the State CEQA Guidelines.

A RESOLUTION OF THE BOARD OF DIRECTORS OF
CARLSBAD MUNICIPAL WATER DISTRICT (CMWD),
ACCEPTING THE CONTRACT FOR CONSTRUCTION OF THE
MITIGATION LANDSCAPE IMPROVEMENTS, LAKE CALAVERA
REMEDIAL IMPROVEMENTS, PROJECT NO. 3821 1-A, AS
COMPLETE.
WHEREAS, the construction of the Mitigation Landscape Improvements, Lake
Remedial Improvements was completed on May 21, 2009; and
WHEREAS, the required 120 day maintenance period has elapsed; and
WHEREAS, all work has been completed to the Carlsbad Municipal Water
satisfaction by LCG Corporation, dba LCG Landscape; and
WHEREAS, all project costs have been established to date.

NOW, THEREFORE, BE IT RESOLVED by the Carlsbad Municipal Water District Board
of the City of Carlsbad, California, as follows:
1 . That the above recitations are true and correct.
2. That the contract for the construction of the Mitigation Landscape Improvements,
Lake Calavera Remedial Improvements, Project No. 3821 1-A is deemed complete and
accepted by the Board of Directors of Carlsbad Municipal Water District.
