RECOMMENDED ACTION:
Adopt Resolution No. 1400 accepting the contract for construction of the Maerkle Disinfection
Facilities Chlorine Gas Scrubbers Replacement, Project No. 5009-A as complete, and directing the
Secretary to record a Notice of Completion and release bonds in accordance with State Law and City
Ordinances.
ITEM EXPLANATION:
On September 9, 2008, the Carlsbad Municipal Water District (CMWD) awarded a contract to Socal Pacific
Construction Corp. in the amount of $508,000 for the construction of the Maerkle Disinfection Facilities
Chlorine Gas Scrubbers Replacement, Project No. 5009-A.
Socal Pacific Construction Corp. completed the work on June 8, 2010. Staff has inspected the work and
found it to be satisfactory. Staff recommends acceptance of the improvements by the Board.
ENVIRONMENTAL IMPACT:
The project is exempt from environmental review per CEQA Guidelines Section 15302(c) - replacement or
reconstruction of existing utility systems and/or facilities involving negligible or no expansion of capacity.

A RESOLUTION OF THE BOARD OF DIRECTORS OF
CARLSBAD MUNICIPAL WATER DISTRICT (CMWD),
ACCEPTING THE CONTRACT FOR CONSTRUCTION OF THE
MAERKLE DISINFECTION FACILITIES CHLORINE GAS
SCRUBBERS REPLACEMENT, PROJECT NO. 5009-A, AS
COMPLETE.
WHEREAS, the construction of the Maerkle Disinfection Facilities Chlorine Gas Scrubbers
Replacement, Project No. 5009-A, has been completed to Carlsbad Municipal Water District's
satisfaction by Socal Pacific Construction Corp. on June 8, 2010; and
WHEREAS, the formal project Notice of Completion has been prepared; and
WHEREAS, all project costs have been established to date.
NOW, THEREFORE, BE IT RESOLVED by the Carlsbad Municipal Water District Board
of the City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the Maerkle Disinfection Facilities Chlorine Gas Scrubbers Replacement,
specifically identified as Project No. 5009-A is deemed complete and is hereby accepted by the
Board of the Carlsbad Municipal Water District.16
3. That the Secretary of the Board is hereby authorized and directed to execute and
record the Notice of Completion for the Maerkle Disinfection Facilities Chlorine Gas Scrubbers

Municipal Water District of the City of Carlsbad on the 13th day of July, 2010, by the
