M — RECOMMENDED ACTION: Adopt Resolution No. 1407 authorizing a refund of construction meter delivery charge to Rita and Roberto Bassi of $1529. ITEM EXPLANATION: Rita Bassi owns the property located at 5841 Edison Place in Carlsbad. At the District's request Roberto Bassi installed a construction meter to provide water to their business while the District disconnected the domestic water meter service for their building to perform a cross connection test. Upon completion of the cross connection test the domestic water meter was reconnected and the construction meter was unconnected and no water was supplied through the construction meter for a period of 10 months. Upon inquiring about their monthly water bill, Rita Bassi was informed that the monthly delivery charge for the construction meter was continuing to be applied to their monthly water bill for the property because the construction meter was not returned to the District. Since no water was being purchased through the construction meter and the construction meter was not required for domestic water service during a period of 10 months, staff is recommending that the delivery charge amount be refunded to Rita and Roberto Bassi at the rate of $152.90 per month for a total refund of $1,529. The Finance Department audited the account, verifying the amount of the refund and ensuring compliance with all other District ordinances. Under the Operating Agreement with the City of Carlsbad the District is to follow the city's accounting policies and procedures. Section 3.32.030 of the Carlsbad Municipal Code requires Board approval of any refund in excess of $1,000. Therefore, staff is recommending approval of a refund to Rita and Roberto Bassi in the amount of $1/529. FISCAL IMPACT: The payment will result in a refund in the amount of $1,529. There is no true fiscal impact, as the payment was for a monthly delivery charge and the construction meter was not used for a period of 10 months.
