RECOMMENDED ACTION:
Adopt Resolution No. 1411 accepting the contract for construction of the Maerkle Pump
Station Upgrade, Project No. 5009-B as complete, and directing the Secretary to record a Notice of
Completion and release bonds in accordance with State Law and City Ordinances.
ITEM EXPLANATION:
On Oct. 27, 2009, the Carlsbad Municipal Water District (CMWD) awarded a contract to Neal Electric
Corp. dba Nealelectric, Inc. in the amount of $188,850 for the construction of the Maerkle Pump
Station Upgrade, Project No. 5009-B.
Neal Electric Corp. dba Nealelectric, Inc. substantially completed the work on Oct. 26, 2010. The final
change order was executed on Dec. 9, 2010. Staff has inspected the work and found it to be
satisfactory. Staff recommends acceptance of the improvements by the Board.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements
of the California Environmental Quality Act (CEQA) pursuant to Section 15268 of the State CEQA
Guidelines.

A RESOLUTION OF THE BOARD OF DIRECTORS OF
CARLSBAD MUNICIPAL WATER DISTRICT (CMWD),
ACCEPTING THE CONTRACT FOR CONSTRUCTION OF THE
MAERKLE PUMP STATION UPGRADE, PROJECT NO. 5009-B
AS COMPLETE.

WHEREAS, the construction of the Maerkle Pump Station Upgrade, Project No. 5009-B
has been completed to the Carlsbad Municipal Water District's satisfaction by Neal
dba Nealelectric, Inc. on Oct. 26, 2010; and
WHEREAS, the formal project Notice of Completion as been prepared; and
WHEREAS, all project costs have been established to date.
NOW, THEREFORE, BE IT RESOLVED by the Carlsbad Municipal Water
of the City of Carlsbad, California, as follows:
1 . That the above recitations are true and correct.
