RECOMMENDED ACTION:
Adopt Resolution No. 1425 accepting the contract for construction of the Gateway Road &
Innovation Way Recycled Water Pipelines, Project No. 52021 as complete, and directing the
Secretary to record a Notice of Completion and release bonds in accordance with State Law and City
Ordinances.
ITEM EXPLANATION:
On March 23, 2010, the City of Carlsbad awarded a contract to Basile Construction, Inc. in the
amount of $369,314 for the construction of the Gateway Road & Innovation Way Recycled Water
Pipelines, Project No. 52021.
Basile Construction, Inc. completed the contract on March 21, 2011. The final change order was
executed on April 18, 2011. City staff has inspected the work and found it to be satisfactory. Staff
recommends acceptance of the improvements by the City Council.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements
of California Environmental Quality Act (CEQA) pursuant to Carlsbad Municipal Code Section
19.040.070 A. 1.a.

A RESOLUTION OF THE BOARD OF DIRECTORS OF
3 CARLSBAD MUNICIPAL WATER DISTRICT (CMWD),
ACCEPTING THE CONTRACT FOR CONSTRUCTION OF THE
4 GATEWAY ROAD & INNOVATION WAY RECYCLED WATER
PIPELINES. PROJECT NO. 52021, AS COMPLETE.

WHEREAS, the construction of the Gateway Road & Innovation Way Recycled Water

Pipelines, Project No. 52021, was completed to the City's satisfaction by Basile Construction, Inc.
on March 21, 2011; and

WHEREAS, the formal project Notice of Completion has been prepared; and
9
WHEREAS, all project costs have been established to date.

NOW, THEREFORE, BE IT RESOLVED by the Carlsbad Municipal Water District Board
of the City of Carlsbad, California, as follows:12
1. That the above recitations are true and correct.13
2. That the Gateway Road & Innovation Way Recycled Water Pipelines, specifically
14
identified as Project No. 52021 is deemed complete and is hereby accepted by the Board of the
15
Carlsbad Municipal Water District.
1R 3. The Secretary of the Board is hereby authorized and directed to execute and
record the Notice of Completion for the Gateway Road & Innovation Way Recycled Water
