DEPT. 778 03/11/2014 Clerk DESIGNATING A CARLSBAD MUNICIPAL WATER DISRICT PROXY FOR THE SAN DIEGO COUNTY WATER AUTHORITY MEETINGS DEPT. HEAD CITY ATTY. CITY MGR. RECOMMENDED ACTION: Adopt Resolution No. 1489 designating the City of Oceanside Board member as proxy for the Carlsbad Municipal Water District (CMWD) Board member should the Carlsbad representative be absent at a San Diego County Water Authority Meeting. ITEM EXPLANATION: Resolution No. 1005 was adopted on December 16, 1997 setting forth the voting proxy for CMWD to a City of Oceanside representative should the CMWD member be absent at a San Diego County Water Authority meeting. On December 22, 2009, a second representative from CMWD was appointed to the San Diego County Water Authority giving CMWD two votes. Therefore, it was no longer necessary to provide CMWD's voting proxy to the City of Oceanside, and the Board adopted Resolution No. 1431 designating two CMWD Board Member's as the proxy should one member be absent while representing CMWD at the San Diego County Water Authority. With the resignation of Board Member Farrah Douglas effective February 7, 2014, the Carlsbad representation is back to one. The replacement for Council Member Douglas' seat will be temporary until the November election. Choosing a replacement member is not advised at this time. It is recommended that the Board choose to designate the City of Oceanside Board member as proxy for the Carlsbad Municipal Water District. FISCAL IMPACT: There is no fiscal impact. WHEREAS, On December 6, 2011, it was no longer necessary to provide CMWD's voting proxy to the City of Oceanside, and the Board adopted Resolution No. 1431 designating two CMWD Board Members as the proxy should one member be absent while representing CMWD at the San Diego County Water Authority. That this Resolution No. 1489 supersedes Resolution No. 1431 adopted December 6, 2011 and provides that the City of Oceanside member shall be the proxy for the absent CMWD member.
