PW-UTIL APPROVAL OF AMENDMENT NO. 5 WITH BROWN & CALDWELL FOR THE DESIGN OF THE AVENIDA ENCINAS RECYCLED WATER LINE PROJECT NO. 5027 CITY MGR. /f\ RECOMMENDED ACTION; Adopt Resolution No. 1502 approving Amendment No. 5 to the Professional Services Agreement with Brown and Caldwell for the design of the Avenida Encinas Recycled Water Line, Project No. 5027. ITEM EXPLANATION; The initial design agreement with Brown and Caldwell was for the design of a new recycled water pipeline in Avenida Encinas, extending from the Carlsbad Water Recycling Facility to Cannon Road. The plans and specifications for this project will be incorporated into the bid package for the Agua Hedionda Sewer Lift Station and Vista/Carlsbad Interceptor Sewer Project in an effort to minimize disruption to the community. The original pipeline design includes 7,200 linear feet of 18-inch diameter polyvinyl chloride (PVC) pipe and approximately 25 recycled water services to convert existing customers from potable to recycled water use. The pipeline will interconnect with existing pipelines located in Palomar Airport Road and in Cannon Road, which will also improve recycled water reliability and quality to District customers. The purpose of the amendment with Brown and Caldwell is to design approximately 3,700 additional linear feet of 12-inch recycled water pipe from the current design end point at Cannon Road to the Agua Hedionda Lagoon, which will provide recycled water service to the proposed power plant and to the Agua Hedionda Sewer Lift Station, Recycled water at the sewer lift station is used for irrigation, odor control and flushing/washing inside the lift station. It is also anticipated that a recycled water pipeline will be extended from this point to the Village at some future date. This project is identified in the 2012 Recycled Water Master Plan and in the Phase III Recycled Water Program, DEPARTMENT CONTACT: Terry Smith at 760-602-2765 or email terry.smith@carlsbadca.gov FOR SECRETARY USE BOARD ACTION: APPROVED CONTINUED TO DATE SPECIFIC DENIED • CONTINUED TO DATE UNKNOWN CONTINUED • RETURNED TO STAFF WITHDRAWN • OTHER - SEE MINUTES AMENDED • REPORT RECEIVED • • • • • Approval of Amendment No. 5 10-7-14 Page 2 of 3 ENVIRONMENTAL IMPACT; A Mitigated Negative Declaration (MND) and Mitigation Monitoring and Reporting Program (MMRP) were prepared for the Agua Hedionda Sewer Lift Station, Force Main and Gravity Sewer Replacement project (PDP 00-02(C)/SP 144(L)/RP 10-26/CDP 10-17/HDP 10-05/SUP 10-02/HMP 10-03). The recycled water line in Avenida Encinas was included as part of this larger project description. The MND was adopted by the City Council on December 6, 2011, in compliance with the California Environmental Quality Act (CEQA) Guidelines Section 15074. Additionally, the 18-inch Recycled Water Pipeline in Avenida Encinas and the 12-inch extension to the north are also part ofthe Phase 11! Recycled Water Program, identified as Expansion Segment No. 2. An environmental impact assessment was conducted for the Phase III Recycled Water Program, and a Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program was approved by the Board through Resolution No. 1455, on November 27, 2012. Furthermore, approval of an amendment with Brown and Caldwell for professional services is exempt from the requirements of CEQA pursuant to Public Resources Code Section 21065. This action does not constitute a "project" within the meaning of CEQA in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require environmental review. PUBLIC NOTIFICATION; None. FISCAL IMPACT; The fee for additional services included in this Amendment No. 5 is $67,830. Also, expenditures related to the design and construction ofthe 12-inch recycled water line will be reimbursed to the City by NRG Energy as a cost to the power plant project. Staff has negotiated a fair and reasonable fee for this work and total design costs with this amendment are within industry standard. RECITALS A. On October 5, 2010, the Parties executed Amendment No. 1 to the Agreement to extend the agreement time period for one (1) additional year; and B. On August 11, 2011, the Parties executed Amendment No. 2 to the Agreement to alter the Agreement's scope of work to provide additional design services for the extension of the recycled water pipeline in Avenida Encinas between Palomar Airport Road and the Encina Water Pollution Control Facility; and C. On November 15, 2011, the Parties executed Amendment No. 3 to the Agreement to extend the agreement time period for one (1) additional year; and D. On February 5, 2013, the Parties executed Ratification of Amendment No. 4 to the Agreement to extend the agreement time period for three (3) additional years and amend the scope of work to include additional design services; and E. The Parties desire to alter the scope of work to include additional design services to extend the recycled water pipeline alignment to serve NRG and the Agua Hedionda Lift Station; and F. The Parties have negotiated and agreed to a supplemental scope of work and fee schedule, which is attached to and incorporated in by this reference as Exhibit "A", Scope of Services and Fee. NOW, THEREFORE, in consideration of these recitals and the mutual covenants contained herein, CMWD and Contractor agree as follows: 1. In addition to those services contained in the Agreement, as may have been amended from time to time. Contractor will provide those services described in Exhibit "A". 2. CMWD will pay Contractor for all work associated with those services described in Exhibit "A" on a time and materials basis not-to-exceed sixty seven thousand eight hundred thirty dollars ($67,830). Contractor will provide CMWD, on a monthly basis, copies of invoices sufficiently detailed to include hours performed, hourly rates, and related activities and costs for approval by CMWD. 3. Contractor will complete all work described in Exhibit "A" by December 16, 2015. 4. Project Management & Administration - Project team coordination, Project Management, invoicing, internal/external meetings, status reports and project controls. 2. Design alignment for 12-inch PVC for DRM, parallel to the forcemain pipeline. Design to be added to Schedule D drawing set. 3. Preferred alignment of RW pipeline shall be within the existing 30 foot City easement paralleling the HDPE force main. 4. City to provide direction on any separation concerns other than as required by State Regulations (min. 4' ODtoOD) 5. RW Pipeline extension design to connect to existing 12-inch reducer and blind flange. (See Schedule D, Detail B/C-11). No hot tap connection. 6. A gravity sewer service connection is to be provided for the power plant. City to provide location and size of connection required.
