RECOMMENDED AaiON:
Adopt Resolution No. 1520 approving and authorizing an increase in the construction
contingency for the Pressure Control Hydroelectric Facility at the Maerkle Reservoir, Project No. 5025.
ITEM EXPLANATION;
On August 27, 2013, the Board adopted Resolution No. 1477 awarding a contract to Environmental
Construction, Inc. (ECl) for the construction of the Pressure Control Hydroelectric Facility at the Maerkle
Reservoir. The resolution provided a construction contingency of $100,000, which is approximately 9.1
percent of the construction award amount. Staff recommends increasing the construction contingency
by $35,000 to a total of $135,000, which is approximately 12.3 percent of the construction award
amount. The increase is necessary due to changes that occurred during the construction of this unique
facility. These changes included modifications to the station piping related to the location of existing
underground facilities. Also, delays in procuring the hydroelectric generator and additional electrical
work necessary to meet current codes resulted in extended overhead costs.

ENVIRONMENTAL IMPACT;
The project is exempt from the California Environmental Quality Act (CEQA) per State CEQA Guidelines
Section 15303(d) - New Construction or Conversion of Small Structures. The City Planner filed a Notice
of Exemption with the County of San Diego on October 18, 2011.

WHEREAS, on August 27, 2013, the Board adopted Resolution No. 1477 awarding a
contract to Environmental Construction, Inc. for the construction of the Pressure Control
Hydroelectric Facility at the Maerkle Reservoir, Project No. 5025; and
WHEREAS, during the course of construction it was determined that changes and
11 associated costs were incurred; and
12 WHEREAS, staff is requesting an increase of $35,000 in the contingency for the

j7 NOW, THEREFORE, BE IT RESOLVED by the Carlsbad Municipal Water District Board of
18 the City of Carlsbad, California, as follows that:
1. The above recitations are true and correct.
2. The contingency amount for Project No. 5025, Pressure Control Hydroelectric
Facility at the Maerkle Reservoir is increased by $35,000 for a total project contingency of
$135,000.
