RECOMMENDED ACTION:
Board of Directors ofthe Carlsbad Municipal Water District (CMWD) Adopt Resolution No. 1529
accepting the contract for construction of the Pressure Control Hydroelectric Facility at the Maerkle
Reservoir, Project No. 5025, as complete, and directing the Secretary to record a Notice of Completion
and release bonds in accordance with State Law and City Ordinances.
ITEM EXPLANATION:
On Aug. 27, 2013, the CMWD awarded a contract to Environmental Construction, Inc. in the amount of
$1,094,652 for the construction ofthe Pressure Control Hydroelectric Facility at the Maerkle Reservoir,
Project No. 5025.
Environmental Construction, Inc. completed the work on June 8, 2015. Staff has inspected the work and
found it to be satisfactory. Staff recommends acceptance ofthe improvements bythe Board.

ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements of
the California Environmental Quality Act (CEQA) pursuant to Carlsbad Municipal Code Section
19.04.070A.l.a. The City Planner also filed a Notice of Exemption with the County of San Diego on Oct.
18, 2011.

MUNICIPAL WATER DISTRICT (CMWD), ACCEPTING THE
CONSTRUCTION OF THE PRESSURE CONTROL HYDROELECTRIC
4 FACILITY AT THE MAERKLE RESERVOIR, PROJECT NO. 5025, AS
COMPLETE AND DIRECTING THE SECRETARY TO RECORD NOTICE
5 OF COMPLETION AND RELEASE BONDS IN ACCORDANCE WITH
STATE LAW AND CITY ORDINANCES.
WHEREAS, the construction ofthe Pressure Control Hydroelectric Facility at the Maerkle
Reservoir was completed to the Carlsbad Municipal Water District's (CMWD) satisfaction by
Environmental Construction, Inc. on June 8, 2015; and
11 WHEREAS, the formal project Notice of Completion has been prepared; and
12 WHEREAS, all project costs have been established to date.
NOW, THEREFORE, BE IT RESOLVED by the CMWD Board of the City of Carlsbad,

California, as follows that:

1. The above recitations are true and correct.

2. That the Pressure Control Hydroelectric Facility at the Maerkle Reservoir,
18 specifically identified as Project No. 5025 is deemed complete and is hereby accepted by the
19 Board of Directors ofthe CMWD ofthe City of Carlsbad.
3. That the Secretary of the Board is hereby authorized and directed to execute and
record the Notice of Completion for the Pressure Control Hydroelectric Facility at the Maerkle
Reservoir, Project No. 5025.
