RECOMMENDED ACTION:
Board of Directors of the Carlsbad Municipal Water District (CMWD) Adopt Resolution No.
1532 accepting the contract for construction of the Recycled Water Phase III Pipeline
Expansion Segment No. 18, Project No. 5208, as complete and directing the Secretary to record a Notice
of Completion and release bonds in accordance with state law and city ordinances.
ITEM EXPLANATION:
On Jan. 13, 2015, CMWD awarded a contract to Burtech Pipeline, Inc. in the amount of $371,834 for the
construction of the Recycled Water Phase 111 Pipeline Expansion Segment No. 18, Project No. 5208.
Burtech Pipeline, Inc. completed the work on Aug. 17, 2015.
Construction contingency funds were used for the excavation of unexpected rock in the trench line
($11,000), resolution of utility conflicts ($14,000), and the installation of additional piping and a new
recycled water hydrant at the fleet yard ($25,000). Staff has inspected the work and found it to be
satisfactory. Staff recommends acceptance ofthe improvements by the Board.

The approval of a Notice of Completion is a ministerial process and is exempt from the requirements of
the California Environmental Quality Act (CEQA) pursuant to Carlsbad Municipal Code Section
19.04.070A.l.a.

WHEREAS, the construction ofthe Recycled Water Phase III Pipeline Expansion Segment
No. 18 was completed to the Carlsbad Municipal Water District's (CMWD) satisfaction by
Burtech Pipeline, Inc. on Aug. 17, 2015; and
11 WHEREAS, the formal project Notice of Completion has been prepared; and
12 WHEREAS, all project costs have been established to date.
NOW, THEREFORE, BE IT RESOLVED by the Carlsbad Municipal Water District Board of

the City of Carlsbad, California, as follows that:

2. That the Recycled Water Phase III Pipeline Expansion Segment No. 18,
18 specifically identified as Project No. 5208, is deemed complete and is hereby accepted by the
19 Board of Directors ofthe CMWD ofthe City of Carlsbad.
