Recommended Action Adopt a Resolution approving plans and specifications and authorizing the secretary of the Board to advertise and receive bids for the Recycled Water Phase Ill Pipeline Expansion Segment 9, Project No. 5208. Executive Summary The Pipeline Expansion Segment 9 is part of the Carlsbad Municipal Water District's (CMWD) $37M Phase Ill Recycled Water Program and will provide recycled water to customers along Navigator Circle, Ponto Drive and Avenida Encinas, south of Poinsettia Lane. Staff recommends approving the plans and specifications and authorizing the secretary to the Board to advertise to receive bids. Discussion CMWD started its recycled water program in 1990 with Phase I, and by 1995 CMWD served over 1,000 acre-feet per year (afy) of recycled water. In 2000, Phase II was initiated with the construction of the 4 million gallons per day (mgd) Carlsbad Water Recycling Facility (CWRF). Phase II pipelines and pump stations were completed in 2008, increasing service to approximately 4,000 afy. The Phase Ill Program began in 2012 with the preparation of a feasibility study and includes the expansion of the CWRF, 18 miles of new pipeline, and the construction of a 1.5 million gallon storage tank. Currently, only the storage tank and 8 miles of pipeline remain to be constructed. The Pipeline Expansion Segment 9 is located along Avenida Encinas (south of Poinsettia Lane), Navigator Circle and Ponto Drive. This project includes the construction of approximately 3,170 linear feet of 8-inch diameter and 1,460 linear feet of 6-inch diameter polyvinyl chloride (PVC) pipeline and recycled water services. Recycled water in these pipeline segments will be used for landscape irrigation. The construction contract contains general performance standards, references technical specifications, and includes a one year warranty period. A 10 percent retention will be withheld from each progress payment until final acceptance of the project. The construction contract includes liquidated damages which may be assessed for each day in excess of the time specified for completion of the work. Page 353 Fiscal Analysis The engineer's estimate of the construction costs of the Recycled Water Phase Ill Pipeline Expansion Segment 9, Project No. 5208 is $1,100,000. This pipeline segment is being funded by the Clean Water State Revolving Fund with 35 percent as a grant from Proposition 1 for Water Quality, Supply and Infrastructure Improvement, and the remainder as a low interest loan. Staff will then return to the Board to recommend awarding a contract to the lowest responsive and responsible bidder. Environmental Evaluation (CEQA) On Nov. 27, 2012, CMWD adopted Resolution No. 1455 adopting a Mitigated Negative Declaration (MND) and Mitigation Monitoring and Reporting Program (MMRP) for the Phase Ill Recycled Water Project (EIA 12-02). This project is a sub-component (ES 9) of the Phase Ill Recycled Water Project and is subject to the Mitigation Measures (MM) that are identified in the MMRP. The project is within the scope of the prior environmental documents and no further environmental documentation is required per CEQA Guidelines Section 15162. All applicable mitigation measures contained in the prior environmental document have been listed as conditions of approval of the recommended CDP and will be incorporated into the construction documents. Public Notification This item was noticed in accordance with the Ralph M. Brown Act and was available for public viewing and review at least 72 hours prior to scheduled meeting date. Exhibits 1. Page 354 RESOLUTION NO. 1572 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD MUNICIPAL WATER DISTRICT BOARD (CMWD), APPROVING PLANS AND SPECIFICATIONS AND AUTHORIZING THE SECRETARY OF THE BOARD TO ADVERTISE AND RECEIVE BIDS FOR THE RECYCLED WATER PHASE Ill PIPELINE EXPANSION SEGMENT 9, PROJECT NO. 5208. EXHIBIT 1 WHEREAS, the Carlsbad Municipal Water District (CMWD) Board of Directors of the City of Carlsbad, California has determined it necessary, desirable, and in the public interest to install approximately 3,170 linear feet of 8-inch diameter and 1A60 linear feet of 6-inch diameter polyvinyl chloride (PVC) pipeline for recycled water services; and WHEREAS, the plans and specifications for furnishing of all labor, materials, tools, equipment, transportation, and other expenses necessary or incidental of said project have been prepared and are on file at CMWD and are incorporated by reference herein; and WHEREAS, an environmental impact assessment was conducted for the Recycled Water Phase Ill Project, Project No. 5208, and a Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program was approved by the Board through Resolution No. 1455, on Nov. 27, 2012; and WHEREAS, the engineer's estimate for the project is $1,100,000; and WHEREAS, sufficient funds exist in the Recycled Water Fund. NOW, THEREFORE, BE IT RESOLVED by the Carlsbad Municipal Water District Board of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the plans, specifications and contract documents for the Recycled Water Phase Ill Pipeline Expansion Segment 9, Project No. 5208, on file at CMWD are hereby approved. 3. That the secretary ofthe Board is hereby authorized and directed to publish, in accordance with State law, a Notice to Contractors Inviting Bids for the construction of the Recycled Water Phase EXHIBIT 1 Ill Pipeline Expansion Segment 9, Project No. 5208, in accordance with the plans, specifications, and contract documents referred to herein.
