HomeMy WebLinkAbout2017-10-24; Municipal Water District; ; Adopt a Resolution accepting bids and awarding a contract to Burtech Pipeline Incorporated for construction of the Recycled Water Phase III Pipeline Expansion Segment 9, Project No. 5208-AOn May 23, 2017, through the adoption of Resolution No. 1572, the CMWD Board approved plans and specifications and authorized the secretary to the Board to advertise to receive bids for the Project. On Sept. 7, 2017, four sealed bids were received for the construction of this Project as shown in the following table: RECYCLED WATER PHASE Ill PIPELINE EXPANSION SEGMENT 9, PROJECT NO. 5208-A CONTRACTOR TOTAL BID 1. Burtech Pipeline Incorporated $1,155,808 2. Orion Construction Corp. $1,192,210 3. Ferreira Coastal Construction Co. $1,253,695 4. Cass Construction, Inc. $1,397,927 Burtech Pipeline Incorporated submitted the lowest bid in the amount of $1,155,808. The engineer's estimate of the construction cost of the Project was $1,100,000. Staff has completed the review ofthe bid documents and has determined that Burtech Pipeline Incorporated is the confirmed low bidder. Burtech Pipeline Incorporated submitted a list of similar projects to show their capabilities and qualifications to perform the specified work. Staff recommends that Burtech Pipeline Incorporated be awarded the contract. The construction contract contains general performance standards, references technical specifications, and includes a one year warranty period. A five percent retention will be withheld from each progress payment until final acceptance of the Project. The construction contract includes liquidated damages which may be assessed in the amount of $1,500 per day for each day in excess of the time specified for completion of the work. Fiscal Analysis As shown in the table below, the estimated total cost of the Project is $1,544,808 and includes the following: construction contract, contingency for change order management, construction management and inspection, engineering support for contractor shop drawings, requests for information and meetings, and community outreach. The Project will be funded by the Recycled Water Ill Pipelines Program, CIP No. 5208. Once this task is complete, staff will schedule a pre-construction meeting with Burtech Pipeline Incorporated and a Notice-to-Proceed will be issued. Cultural monitors for the Project have indicated that additional monitoring may be required which would impact the construction schedule. The duration of the construction contract is 90 working days, exclusive of rain days and change orders that may extend the contract duration. Upon the successful completion of the Project, staff will request the secretary of the Board to record a Notice of Completion and to release bonds. Environmental Evaluation (CEQA) On Nov. 27, 2012, CMWD by Resolution No. 1455 adopted a Mitigated Negative Declaration (MND) and Mitigation Monitoring and Reporting Program (MMRP) for the Phase Ill Recycled Water Project {EIA 12-02). This Project is a sub-component (ES 9) ofthe Phase Ill Recycled Water Project and is subject to the Mitigation Measures (MM) that are identified in the MMRP. The Project is within the scope of the prior environmental documents and no further environmental documentation is required per CEQA Guidelines Section 15162. All applicable mitigation measures contained in the prior environmental document have been incorporated into the construction documents. Public Notification This item was noticed in accordance with the Ralph M. Brown Act and was available for public viewing and review at least 72 hours prior to the scheduled meeting date. Prior to the start of construction, the public will be notified of the construction activities using media methods such as signage, email, website, and other city communication channels. The construction contractor will also be required to notify the public of construction activities via changeable message signs, door hangers, letters to residents, and/or "NO PARKING" signs, as applicable. EXHIBIT I WHEREAS, the Carlsbad Municipal Water District Board of the City of Carlsbad, California has determined it necessary, desirable, and in the public interest to install approximately 3,170 linear feet of 8-inch diameter and 1,460 linear feet of 6-inch diameter polyvinyl chloride (PVC) pipeline for recycled water services; and WHEREAS, on May 23, 2017, through the adoption of Resolution No. 1572, the Carlsbad Municipal Water District (CMWD) Board approved plans and specifications, and authorized the secretary to the Board to advertise to receive bids for the construction of the Recycled Water Phase Ill Pipeline Expansion Segment 9, Project No. 5208-A (Project); and WHEREAS, an environmental impact assessment was conducted for the Phase Ill Recycled Water Project, and a Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program was approved by the Board through Resolution No. 1455, on Nov. 27, 2012; and WHEREAS, on May 3, 2017, through the adoption of Planning Commission Resolution No. 7241, the Planning Commission of the City of Carlsbad approved a Coastal Development Permit to construct the Project; and WHEREAS, four sealed bids were received on Sept. 7, 2017, by CMWD, for the construction of the Project; and WHEREAS, the lowest responsible bid was submitted by Burtech Pipeline Incorporated in the amount of $1,155,808; and October 24, 2017 Item#6 Page 5 of 8 EXHIBIT 1 WHEREAS, funds have been appropriated from the Recycled Water Phase Ill -Pipelines, CIP No. 5208 and are sufficient for the completion of this Project; and WHEREAS, subsection 3.28.040(C){5) of the Carlsbad Municipal Code authorizes the executive manager to approve change orders in the amount equal to the contingency set at the time of project award. NOW, THEREFORE, BE IT RESOLVED by the Carlsbad Municipal Water District Board of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the bid in the amount of $1,155,808 submitted by Burtech Pipeline Incorporated for construction of the Recycled Water Phase Ill Pipeline Expansion Segment 9, Project No. 5208-A, is accepted and the president of the Board is hereby authorized to execute a contract with Burtech Pipeline Incorporated. 3. That the executive manager or designee is hereby authorized to approve construction change orders up to $139,000. 4. That the award of this contract is contingent upon the bidder submitting the lowest responsible bid, executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within 20 days of adoption of this Resolution. The executive manager may grant reasonable extensions oftime. The responses are provided below: TOPIC: October 24 Agenda Item #2 -Advertise for bids for Simsbury Sewer Extension Q. Did the Quarry Creek development pay for any of the Simsbury project? A. Mark Biskup: The developer extended the sewer pipeline to the edge of their property line for the Simsbury connection and sized the pipeline to collect the flow in addition to the development flow. They also paid sewer benefit area fees, which are specific to this Local Facilities Management Zone and are in addition to connection fees. TOPIC: October 24 Agenda Item #6-Award for contract for Recycled Water Pipeline Expansion Segment 9 Q. Did the hotel developer pay fees toward the Recycled Water Segment 9 through the city's Growth Management Plan? A. Lindsay Leahy: The developer will pay for all of their own water, recycled water, and sewer infrastructure in the area, including connection/capacity fees. However, the new recycled water expansion will serve several properties in the area. Therefore, they will not pay for the recycled water pipeline expansion servicing other properties in the vicinity. The recycled water line is not a growth management facility.
