Capriati Construction Corp. submitted the lowest bid in the amount of $1,898,078. The
engineer's estimate of the construction cost was $1,600,000. The bid cost was higher than
estimated. This is likely due to the unique nature of the Project, which includes 19 distinct
construction sites, each requiring a mobilization/demobilization effort. In addition, several of
the locations are within North County Transit District (NCTD} or Caltrans right-of-way or in close
proximity to high traffic areas, such as the Village and schools. To minimize impacts to the city,
these locations require work to be scheduled at night, during school breaks, or outside of
scheduled civic events.
Staff has completed the review ofthe bid documents and has determined that Capriati
Construction Corp. is responsive and responsible and the confirmed low bidder. Capriati
Construction Corp. submitted a list of similar projects to show their capabilities and
qualifications to perform the specified work. Staff recommends that Capriati Construction
Corp. be awarded the contract.
The construction contract contains general performance standards, references technical
specifications, and includes a one year warranty period. A five percent retention will be
withheld from each progress payment until final acceptance of the project. The construction
contract includes liquidated damages which may be assessed in the amount of $2,500 per day
for each day in excess of the time specified for completion of the work.
Fiscal Analysis
The Project will primarily be funded by the Water Valve Repair/Replacement Program, CIP No.
5019, with the condition assessment work estimated at $25,388 being funded by the Water
Condition Assessment Program, CIP No. 5051.
The construction contract with Capriati Construction Corp. is for $1,898,078. An estimated
contingency of $237,260 is assigned to this Project due to the complex nature of the Project
that includes 19 different sites, each with separate mobilization/demobilization, sequencing,
and potential for unknown conditions.
As shown in the table below, the estimated construction phase cost of $2,610,338 includes: a
construction contract; contingency for change orders management; construction management
and inspection; and engineering and administrative support for contractor shop drawings,
requests for information, meetings, and community outreach. With the exception of the
condition assessment line item, all other Project costs will be funded by the Water Valve
Repair/Replacement Program, CIP No. 5019.

Next Steps
Once awarded, staff will provide the contract to Capriati Construction Corp. for their execution
and request that Capriati Construction Corp. provide the required bonds and proof of
insurance. On,ce this task is complete, staff will schedule a pre-construction meeting with
Capriati Construction Corp. and a Notice-to-Proceed will be issued.
The duration of the construction contract is 250 working days, exclusive of weather-related
events and change orders that may extend the contract duration. Upon the successful
completion of the Project, staff will request that the executive manager accept the construction
of the Project, and record a Notice of Completion and to release bonds.
Environmental Evaluation (CEQA)
This Project is exempt from California Environmental Quality Act (CEQA) review pursuant to
CEQA Guidelines Section 15302(c) -Replacement or reconstruction of an existing utility system
and/or facility involving negligible or no expansion of capacity.
Public Notification
This item was noticed in accordance with the Ralph M . Brown Act and was available for public
viewing and review at least 72 hours prior to the scheduled meeting date. Prior to the start of
construction, the public will be notified of the construction activities using media methods such
as signage, email, website, and other city communication channels. The construction
contractor will also be required to notify the public of construction activities via changeable
message signs, door hangers, letters to residents, and/or "NO PARKING" signs, as applicable.

This Project will result in short-term water service disruptions at each of the 19 locations when
the new valves are installed. Construction at some of the locations may also disrupt traffic and
access. CMWD staff will complete public outreach within the vicinity of each valve replacement
site for general notification of upcoming construction, as well as properly notify customers of
any water service interruptions or traffic/access impacts during construction.

A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD
MUNICIPAL WATER DISTRICT BOARD (CMWD), ACCEPTING BIDS AND
AWARDING A CONTRACT TO CAPRIATI CONSTRUCTION CORP. FOR THE
CONSTRUCTION OF THE VALVE REPLACEMENT: PHASE I, PROJECT NO. 5019-
A.
EXHIBIT 1
WHEREAS, the Carlsbad Municipal Water District Board of the City of Carlsbad, California has
determined it necessary, desirable, and in the public interest to replace broken valves at prioritized
locations and concurrently make other improvements and conduct condition assessment at the same
locations; and
WHEREAS, on Aug. 22, 2017, through the adoption of Resolution No. 1580, the CMWD Board
approved plans and specifications, and authorized the secretary to the Board to advertise to receive
bids for the Valve Replacement: Phase I, Project No. 5019-A (Project); and
WHEREAS, the Project is exempt from CEQA per State CEQA Guidelines Section 15302(c) -
replacement or reconstruction of an existing utility system and/or facility involving negligible or no
expansion of capacity; and
WHEREAS, three sealed bids were received on Nov. 8, 2017, by CMWD, for the construction of
the Project; and
WHEREAS, the lowest responsible bid was submitted by Capriati Construction Corp. in the
amount of $1,898,078; and
WHEREAS, funds have been appropriated from the Water Valve Repair Replacement Program,
CIP No. 5019 and are sufficient for the completion of this Project; and
WHEREAS, subsection 3.28.040(C)(5) of the Carlsbad Municipal Code authorizes the executive
manager or designee to approve change orders in the amount equal to the contingency set at the time
of Project award.

EXHIBIT I
NOW, THEREFORE, BE IT RESOLVED by the Carlsbad Municipal Water District Board of the City
of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the bid in the amount of $1,898,078 submitted by Capriati Construction Corp. for
construction of the Project, is accepted and the president of the Board is hereby authorized to execute
a contract with Capriati Construction Corp.
3. That the executive manager or designee is hereby authorized to approve construction
change orders up to $237,260.
4. That the award of this contract is contingent upon Capriati Construction Corp. executing the
required contract and submitting the required bonds and insurance policies, as described in the
contract, within 20 days of adoption of this Resolution. The executive manager may grant reasonable
extensions of time.
PASSED, APPROVED AND ADOPTED at a Special Meeting of the Carlsbad Municipal Water
District Board of the City of Carlsbad on the 12th day of December, 2017, by the following vote, to wit:
