Staff determined the needs for water pipeline repair/replacement and valve replacement that are appropriate for job order contracting. On Nov. 4, 2019, a Request for Bids was advertised using the city's formal bidding procedures. A mandatory pre-bid meeting was held on Dec. 5, 2019 with 12 contractors in attendance. A bid opening was held on Dec. 13, 2019, and one sealed bid was received from HPS Plumbing Services for water pipeline repair/replacement and valve replacement. Based on an evaluation consistent with CMC Section 3.28.087 the bid was deemed responsive and responsible. Staff recommends CMWD execute a JOC with HPS Plumbing Services for an initial term of three years, with the option to extend for two additional one-year periods, for a total term of five years. Fiscal Analysis The maximum contract value over the five-year term is $1 million, consistent with CMC Section 3.28.087. Task orders for specific projects are executed against the value of the contract. Task order values are constrained by availability of project funding appropriated through regular annual budgeting processes. The JOC will be subject to annual price adjustments on the anniversary of the contract award date, based on the widely recognized industry standard Construction Cost Index published by Engineering News-Record. Next Steps As specific projects are identified, staff will execute task orders against the JOC that include a detailed scope of work, completion time and a total lump-sum fixed price. Environmental Evaluation (CEQA) Pursuant to Public Resources Code Section 21065, this action to award a JOC does not constitute a "project" within the meaning of the California Environmental Quality Act (CEQA) in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect change in the environment, and therefore does not require environmental review. Public Notification This item was noticed in accordance with the Ralph M. Brown Act and was available for public viewing and review at least 72 hours prior to the scheduled meeting date. Exhibits 1. CMWD Resolution Feb. 25, 2020 Item #9 Page 2 of 4 CMWD RESOLUTION NO. 1634 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD MUNICIPAL WATER DISTRICT OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING A JOB ORDER CONTRACT (JOC) TO HPS PLUMBING SERVICES FOR WATER PIPELINE REPAIR/REPLACEMENT AND VALVE REPLACEMENT WHEREAS, the Carlsbad Municipal Water District (CMWD) Board of Directors (Board) of the City of Carlsbad, California has determined it necessary, desirable, and in the public interest to perform water pipeline repair/replacement and valve replacement using job order contracting; and WHEREAS, job order contracting allows for recurring repair or construction work to be completed under a single competitively bid contract using firm, fixed pricing; and WHEREAS, Carlsbad Municipal Code (CMC) Section 3.28.087 provides definitions and guidelines for the award, use and evaluation of JOCs; and WHEREAS, a formal bidding process for a JOC for water pipeline repair/replacement and valve replacement was completed on Dec. 13, 2019; and WHEREAS, HPS Plumbing Services submitted the lowest responsive and responsible bid; and WHEREAS, the initial term of the JOC is three years, with the option to extend for two additional one-year periods, for a total term of five years; and WHEREAS, the JOC has a maximum contract value of $1 million over the five-year term, consistent with CMC Section 3.28.087; and WHEREAS, CMC Section 3.28.087(D)(2) authorizes the executive manager to issue task orders less than the dollar amount specified in California Public Contract Code Section 22032(b); and WHEREAS, expenditures against these JOCs are subject to availability of project funding appropriated through regular annual budgeting processes. NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Carlsbad Municipal Water District of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the low bid submitted by HPS Plumbing Services for water pipeline repair/replacement and valve replacement is accepted and the president of the Board is hereby authorized to execute a JOC for this work. That the executive manager or designee is hereby authorized to issue task orders against JOCs in accordance with the dollar amount specified in California Public Contract Code Section 22032(b)(A). 4. That the award of this contract is contingent upon HPS Plumbing Services executing the required JOC and submitting the required bonds and insurance policies, as described in the contract, within 20 days of adoption of this Resolution. The executive manager may grant reasonable extensions of time. PASSED, APPROVED AND ADOPTED at a Special Meeting of the Board of Directors of the Carlsbad Municipal Water District of the City of Carlsbad on the 25th day of February 2020, by the following vote, to wit: AYES: Hall, Blackburn, Bhat-Patel, Schumacher.
