I. : PRO,JECT DESCRIP'I'ION The applicant is requesting to prezone the subject property 4 from the County zone of s~-90 to R---1 in order· to alJ.ow subsequent annexation and development in the city. The subject property is a 12. 36 acre parcel located off Laurel trree Road approx·-· imat:.ely a quarter of a mile south of Palomar Airport Road. Most of the property consists of sloping land covered with native vegetatfon.r however, the southwesterly third of the property has been previously graded and is devoid of any native veg·etation. l'J. large si.ngle family dwelling is located on the southwesterly portion of the property. In the past, thi.S. building was utilized as an off ice and heavy equipment wa,s stored on the property. 'I'he -hOusE:~ is being used a;,'. a single family residence at the ·present time. · The properties to th~ east, wesf, and south are vacant at the present time. ·while the· p:roperty to the north is being utilized for agricultural purposes and has an agricultural proc~ssing plint on it. The applicant h~s indicated that hrs orgariization wishes to eieritually constiuct a retirement borne on this property l consisting of chlSter housing. Cqn~truction o~ thi~ facility w6uld require subsequent a,pproval of a Planned Unit Development by the Planning Cornroission. II. ANALYSIS 1. Is the proposed R-1 zon~ consis.tent with t~e RLM Gerieral Plan des~gnation? 2. Is the propose~ R-1 zone consistent with existing surroundin9 zoning and land use? 3~ Is the proposed R-1 zone premature at this time and would a,nothe.r zone b(~ rn.orc Rppropriate:~·; I, ( ( Discussion 'l'he RLM (Residential Low-Medium Density, 0·-4 du/ac) designation of the General Plan is intended to allow the type of residential development that would occur in the requested R--·1 zone. Therefore, R-1 zoning would be consistent with the General Plan designation for this property. Staff is concerned, however, as to whether the R-1 zone would be consistent with the existin~ surrounding zoning and land use in the irea and whether the requested R-1 zone is premature at this timeo The subject property is rather isolated from the nearest residentially developed property and approximately a mile from the nearest existing R-1 zone. The nearest existing· residential deve·t -Jpment is located at Alt.a Mira, approximately a half mile tot west of the subject property. The subject property .s contiguous to the City of Carlsbad along its northern bounoary only. However, this propqrty has a zoning of E-A (Exclusively Agricultural) which ha.s a minimum lot size of 10 acres. · It is the staff's feeling that a zoning of R-1 would not b~ appropriate for this parcel at the present time. Approval of the requested zoning would resul~ in an isolated R-1 £:oning district completely surrounded on all four sides by z011ing permit.ting a much lower density of development than would be pe:i;mitted in the R-1 zone and requiring a much lower level of pub~ic services. Plann :'._ng staff feels :that a zoning of L-C (Lirni ted Control) would be the appropriate zoning for this property at t~is ·time. The L-C (Limited Control) zone is an interim type of zoning which would allow the property to annex into the city, but would not allow it to be used for other than agricultural type purposes. At a future date, when the surrounding area is also ready to develop ai a more intense level and a higher level of public services are availabler the applicant wquld be able to apply for a zone change frorn L-C to R-1. . It shou~d be pointed out that although the applicant h1s indicated an intention to develop the property with a specific use, the Planning Commission's consideration should focus on the proper zoning for the property given the major planning issues listed above. III. APPLICANT: SUDAN INTERIOR MISSION CASE NO: ZC-214 WHEREAS, a verified application for certain property, to wit: A portion of Lot "G 11 of Rancho Agua Hedionda, San Diego County, Map No. 823, dated November 16, 1896 has been filed with the City of Carlsbad, and referred to the Planning Commission; and WHEREAS, said application constitutes a request as provided by Tit 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 13th day of August, 1980, August 27, 1980, and September 10, 1980, hold a duly noticed public hearing as said request; and scribed by law to consider WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Zone Change; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning 23 Commission as follows: 24 25 26 27 28 A) B) That the foregoing recitations are true and correct. That based on the evidence presented at the public hearing, the Commission recommends APPROVAL of ZC-214, based on the following findings: Findings: 1) That the proposed zone of R-1-10,000-Q is consistent with The General Plan Land Use desiqnation of RLM -Residential Medium Low Density (0-4 du's/AC). • l 2) 2 3 3} 4 5 • • That the zoning designation of R-1-10,000 limits the density so that existing public facilities can adequately serve the property. That the Q overlay designation will ensure that the density, design and type of development will not create an excessive demand on public facilities.
