DATE: September 24, 1980 Planning Commission Planning Department TO: FROM: SUBJECT: ZC-216 -MALOY -Reque:::rt for a Zone Change from R-1~7500 to R-P on property generally located on the northeast corner of Madison Street and Arbuckle Place. · · I. PROJECT DESCRIPTION The applicant is proposing ft change 0£ zone from R-1-7500 to R-P (Residential/Professional) on two 5000 square foot parcels of land ~aking up the northeast corner.of Madison Street and Arbuckle Place. The corner parcel, .. fronting on r bo~h Madison Street and Arbuckle Place is presently occupied by a duplex. The adjacent parcel, fronting on Arbuckle Pla~~ is a graded vacant lot. II. ANALYSIS ·planning Is["ues .. 1. Is the xequested zone change consistent with the land use element of ~he gene~al blan? 2. Do the subject parcels meet the lot width and area requirements of the zone code for the requested zone? 3. ·would the requested zone change adversely impact surrounding properties? : 4. Is the street system serving the project adequate to handle any increase in traffic generated by the change of zone? Discussion The ~pplicant is proposing a zone change from R-1-7500 to R-P (Residential/Professional). The retjuested ichange of zone would be consistent with the RMH/O designation of.the land use element of the general plan for this property . . RMH/O denotes a combination district permitting residential develdpment to a medium-high density and professional and related commercial uses. · · ( ( In order for the subject property to meet the lot width and area requirements of the zoning code, it will be necessary to combine the two parcels into one lot. Except for the southwest corner pa~cel on Arbuckle Place and Jefferson Stieet, all lots frohting on Arbuckle Place are . presently zoned R-1-7500 as shown on the attached exhibit. However, alJ_ other surrounding properties between Jefferson Street and Madison Street are zoned R-P. This· area is a·n older neighborhood _ii:i, transition from single family homes to multiple-family residences,and office/ professional.uses. Rezoning of the subject property to R-P. would be compatible with surrounding uses and · zoning excep·t for the R-r zoning along Arbuckle Place. The Commiss~on may w{sh to set the balance of the block to public hearing to consider rezoning the R-1 properties on Arbuckle Place to R-P to bring the entire block into ccinformance with the general plan and make it consistent with all the surrounding zoning. The R-P zone would permit the existing residential ~ses on Arbuckle while providing for future development and renovation of the neighborhood. · As all surrounding zoning, {R-P, C-2., and ~~3) permit development similar or compatible with those uses permitted by the requested zone change, no·adv~rse impacts are anticipated.to surrounding properties. The R-P designation would seem appropriate for this area as it serves as.a transitionary zone between the C-2, Central Business District and to the southwest and higher density residential development, R-3 to the north and east. A slight'increase in traffic generated ·to this area may be expected by uses allowed in the R-P zone.·· Both Madison Street and Arbuckle Place are specified as local streets. Tq conform with the standard's established in the. circulation ~lement of the general plan, a condition of approval has. been added to this reso~ution requiring dedication and a· future improveme.nt agreement of street frontage on Madison Street and Arbuckle Place. Staff feels that future improvements to these streets will mitigate any potentia+ traffic concerns . • It is staff's opinion that a rezoning of .the subject property tp R-P is ap~ropriate and would not result in any adver~e impacts to surrounding properties. ' The applicant should be aware that prior to the is~uante of any briilding permit or business license to convert the existing use of the property, all applicable city ordinances will have ·to be.complied.with and i plan for parking lot improvements. will have to be approved by the Planning Director. -2- . '. ( ( III. RECOMMENDA'rION It is recommended that the Planning _Commission ADOP'r Resolutiop No. 1696, APPROVING ZC-216~_based on-the findings and subject to the -condi ti~ms contained therein. It is also recornmended that the Planning Commission direct staff to set to public hearing consideration of rezoning the other lbts along Arbuckle Place from the R-1 to ~-P zone. '-< -· l 2 3 4 5 6 7 wit: 8 9 • • PLANNING COMMISSION RESOLUTION NO. 1696 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A ZONE CHANGE FROM R-1-7500 TOR-PON PROPERTY GENERALLY LOCATED ON THE NORTHEAST CORNER OF MADISON STREET AND ARBUCKLE PLACE. APPLICANT: MALOY CASE NO: ZC-216 WHEREAS, a verified application for certain property, to A portion of Lot 47 of Seaside Lands, according to map thereof No. 1722, filed and recorded July 28, 1921 has been filed with the City of Carlsbad, and referred to the 10 11 12 Planning Commission; and WHEREAS, said application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and 13 14 15 16 17 18 19 WHEREAS, the Planning Commission did on the 24th day of September, 1980, hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered factors relating to the Zone Change; and 20 21 22 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: A) 23 That the foregoing recitations are true and correct. 24 25 26 27 28 B) That based on the evidence presented at the public hearing, the Commission recommends APPROVAL of ZC-216, based on the following findings and subject to the following conditions: Findings: 1) That the Zone Change to R-P is consistent with the designation of RMH/O for this property in the Land Use Element of the General Plan. .. • _ _,. l 2) 2 3) 3 4 4) 5 6 7 • • That the uses permitted by the R-P zoning are consistent and compatible with other uses permitted in the area. That the subject lot is adequate in size and shape to accommodate uses permitted in the R-P zone. That the zone change will not cause any significant environ- mental impacts since based on an initial study of the project, including a field investigation of the site, the Planning Director has determined that the project will not result in any adverse environmental impacts and therefore has issued a declaration of negative environmental impact on September 9, 1980, Log No. 750. 8 Conditions : 9 1) 10 11 12 13 14 15 2) 16 17 18 19 This project is approved upon the express condition that the applicant shall pay a public facilities fee as required by City Council Policy No. 17, dated August 29, 1979, on file with the City Clerk and incorporated herein by reference, and according to the agreement executed by the applicant for payment of said fee a copy of that agreement dated July 24, 1980, is on file with the City Clerk and is incorporated herein by reference. If said fee is not paid as promised, this application will not be consistent with the General Plan and approval for this project shall be void. The applicant shall apply for an adjustment plat to combine the two lots prior to the issuance of a building permit or business license. As a condition of approval of this adjustment -plat, the applicant shall make all necessary dedications for the widening of Madison and Arbuckle Place and shall enter into a lien contract for future improvement of the streets. PASSED, APPROVED AND ADOPTED at a regular meeting of the 20 Planning Commission of the City of Carlsbad, California, held on 21 the 24th day of September, 1980, by the following vote, to wit: 22 23 24 25 26 27 AYES: Commissioners Jose, Larson, Leeds, Schick, and Friestedt.
