I. PROJECT DESCRIPTION The applicant is requesting a variance to permit the construction of a double faced roof sign and to increase the permitted sign area for Hadley's, located as described above. The proposed roof sign will be 14 feet high and 23 feet long with an area of 322 square feet (644 square feet if the double face is counted). The actual area of the lettering on one side would be 172.5 square feet. The applicant already has 198 square feet of signs on their building. With the addition of the roof sign, they would have a total of 520 square feet of signs. According to Carlsbad's Sign Ordinance, a total of 244 square feet of sign area is allowed. The applicant has indicated that he would be willing to delete a portion or all of their existing signs in order to obtain approval of this sign. The applicant is requesting this variance because he feels that the recently constructed Motel 6 prevents northbound traffic on Interstate 5 from seeing the sign on the southern side of his building. I1 . ANALYSIS Planninq Issues 1. Can the four mandatory findings of a variance be found in this case which are as follows: a. Are there exceptional or extraordinary circum- stances applicable to the property that do not apply to other property in the vicinity? b. Do other properties in the vicinity share a similar right which is denied to this property? c. Will this variance adversely affect the comprehen- sive General Plan? d. Will this variance be detrimental to other proper- ties in the vicinity? Discussion Staff feels that there are no exceptional or extraordinary cir- cumstances applicable to this property that are not applicable to other properties in the vicinity. The end result of approving this variance would be to permit the construction of a large freeway oriented roof top sign. Hadley Fruit Orchards is not a freeway service facility as defined by the Carlsbad Zoning Ordinance and approval of such a sign could set an undesirable precedent for other commercial developments along Interstate 5. Staff believes that there are no exceptional or extraordinary circumstances that relate to this project, and therefore, cannot make the first finding for a variance. There are no other buildings in the vicinity that have roof top signs or exceed the area requirements of the sign ordinance. Staff does not believe that this property is being denied a prop- erty right shared by other properties in the vicinity. The approval of this variance will not adversely effect the com- prehensive general plan, but could have a detrimental effect on other properties in the vicinity because a roof sign could be potentially unattractive to adjacent properties along Paseo Del Norte and to motorists driving both on Paseo Del Norte and Interstate 5. Additionally, the Planning Commission and City Council recently approved ZCA-145. The purpose of this zone code amendment was to eliminate existing, illegal freestanding and roof top signs. Approval of this variance would be contrary to the intent of this zone code amendment and would make it difficult for the city to eliminate these signs. Since staff cannot make all four of the required findings nec- essary for granting a variance, it is recommended that this application be denied. IV. ENVIRONMENTAL REVIEW The Planning Director has determined that this project is cate- gorically exempt from environmental review according to Section 19.04.070(6)(E) of the city of Carlsbad Environmental Ordinance. V. RECOMMENDATION It is recommended that the Planning Commission ADOPT Resolution No. 1970, DENYING V-338 based on the findings contained therein. ATTACHMENTS 1. PC Resolution No. 1970 2.
