INFORMATION ITEM DATE: May 23, 1984 TO: Planning Commission FROM: Land Use Planning Office SUBJECT: PUD-39(B) -TELESCOPE POINT -Request for a minor amendment to a previously approved planned unit development located west of Neblina Drive and south of the future Tamarack Avenue in the R-A-10,000 zone. I. RECOMMENDATION It is recommended that the Planning Commission ADOPT Resolution No. 2297 APPROVING PUD-39(B), based on the findings and subject to the conditions contained therein. II. PROJECT DESCRIPTION The applicant is requesting a minor amendment to a previously approved planned unit development for 65 single family residences located as described above. The previously approved project had a f~at, grassy play area in the northe~st portion of the project adjacent to the RV storage area. The applicant proposes to replace this play area with a lighted tennis court. Other than this modification, the applicant is proposing no changes to the previously approved project. The proposed amendment will have no affect on the tentative map that was approved concurrently with the planned unit development. III. ANALYSIS Planning Issue 1) Is the revised project essentially in conformance with the previously approved planned unit development? Discussion Staff believes that the proposed project is substantially in conformance with the previously approved project. As mentioned, the only change will be a substitution of a lighted tennis court for a grassy play area. Staff and the applicant had some concerns about the affect of the proposed tennis court on the existing residences to the east. To mitigate any adverse impacts staff is proposing some additional conditions regarding the proposed tennis court: 1) The lighting system for the tennis court shall be designed so that no light spills over onto the adjacent residences. 2) The hours of use of the proposed tennis court shall be limited to between 7:00 a.m. and 10:00 p.m. This restriction shall be clearly stated in the CC&R's of this project and shall be posted on the courts. This item is being processed per section 21.45.160(2) of the Planned Development Ordinance which permits the Planning Commission to approve a minor revision to a planned development and make it a part of the original City Council approval without the necessity of a public hearing before the City Council. Although not required by ordinance, all property owners within 300 feet of the subject property were notified. Staff and the applicant felt it was necessary to notify nearby residences to assure that they were aware of the proposed change. Staff believes that as conditioned, the proposed tennis court will not adversely affect adjacent residences, therefore, staff recommends approval of PUD-39(B). III. ENVIRONMENTAL REVIEW The Land Use Planning Manager has determined that this project has already been considered in conjunction with a previously certified environmental document and, therefore, has issued a Notice of Prior Environmental Compliance dated May 8, 1984.
