I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 3095 APPROVING an eight year extension of CUP 248xl based upon the findings and subject to the conditions contained therein. IL PROJECT DESCRIPTION AND BACKGROUND On July 25, 1984, the Planning Commission adopted Planning Commission Resolution No. 2322 allowing the installation and operation of a temporary modular office building at the Carlsbad Civic Center on the northeast comer of Carlsbad Village Drive (Formerly Elm Avenue) and Pio Pico Drive. At that time, staff had reservations concerning the increased parking demand and recommended that the Planning Commission deny the project. Due to the lack of space for municipal departments, and the impending completion of the Safety Center, the Commission approved the temporary modular facility for a period of three years at which time the adequacy of public administration facilities would be reevaluated. Since 1984, two additional facilities have been constructed, namely the Safety Center and the Community Development Building, however there is still a shortage of office space at City Hall. Long term plans call for a new City Hall that would be large enough to accommodate all public administration facilities, however, in the short term other City-wide public facilities have had priority in construction. The modular buildings are still heavily used by the Purchasing, Finance and Risk Management Departments and additional space 1s many years away. - CUP 248xl CI1Y O~SBAD SEPTEMBER 19, 1990 PAGE 2 III. ANALYSIS 0 The existing modular facility is necessary for the development of the community as it accommodates needed City staff. The General Plan calls for adequate public administration facilities which cannot be accommodated without the existing temporary offices. Because the modulars are being used by City staff, the use is not detrimental to other existing uses in the Civic Center, and the operations at City Hall do not produce any adverse effects on surrounding land uses. The City Hall complex is now parked at a ratio of 1 space per 242 square feet while the parking required for office uses is 1 :250. The completion of the Safety Center allowed the Police Department vehicles, which impacted the City Hall parking situation, to be stored elsewhere and allowed the uses at City Hall to be closer to solely office uses. The modular facility does not encroach into any setbacks, affords all required pedestrian and handicapped access, and does not cause the Civic Center to exceed the parking required by the Carlsbad Municipal Code. The existing hedge located along the southern side of the modular facility also adequately screens the modulars from Carlsbad Village Drive. Given that the findings required for a Conditional Use Permit can still be made, and the fact that even with the existing modular facility, more space is still needed for public administration facilities, staff recommends an extension of CUP 248 for five years from the date of this action. Since this Conditional Use Permit expired on July 24, 1987, the actual time of extension totals eight years and two months. IV. ENVIRONMENf AL REVIEW The Planning Director has determined that the extension of a public serving use is exempt from environmental review per Section 15301(1)(b) of the California Environmental Quality Act and has filed a Notice of Exemption on April 12, 1990.
