AGENDA OF: June 21, 1995 Item No.@ Application complete date: May 3, 1995 Project Planner: Teresa Woods Project Engineer: Ken Quon SUBJECT: SDP 95-05 -CANTATA -AVIARA PLANNING AREA 27 -Request for a Site Development Plan for 35 single-family detached residences within a previously approved subdivision on a 15.5 acre site located north of Batiquitos Drive between Kestrel Drive and Blackrail Court, in Local Facilities Management Zone 19. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 3778, APPROVING the Negative Declaration issued by the Planning Director and ADOPT Planning Commission Resolution No. 3779, APPROVING SOP 95-05, based on the findings and subject to the conditions contained therein. II. INTRODUCTION This application proposes architectural elevations, floor plans and the plotting of units pursuant to the approved Aviara Master Plan (MP 177(N)). The proposed architectural elevations, floor plans and unit plotting are consistent with all City codes, policies and ordinances as well as the Aviara Master Plan. There are no issues associated with this Site Development Plan request. III. PROJECT DESCRIPTION AND BACKGROUND The applicant is requesting approval of a Site Development Plan to allow the construction of 35 single-family homes in Aviara Planing Area 27, which is located within Phase II of the Aviara Master Plan (MP 177(N)) and within the P-C Zone. The project is also subject to the conditions of the approved Tentative Tract Map (CT 90-34) for Aviara Planning Area 27. This Tentative Tract Map was approved for 36 lots including 35 single-family lots (minimum lot size 7,500 square feet) and one open space lot. The Master Plan requires the approval of a Site Development Plan prior to issuance of building permits. Further, Condition No. 25 of Planning Commission Resolution No. 3324 approving CT 90-34, reiterates the Master Plan requirement for a site development plan. The intent of the Site Development Plan is to ensure that all applicable development standards and design criteria of the Master Plan are incorporated into any proposed construction. SDP 95-05 CANTATA -.IARA 0 PLAN~G AREA 27 JUNE 21, 1995 PAGE2 Aviara Planning Area 27 is located north of Batiquitos Drive, between Kestrel Drive and Blackrail Court. The project site and the surrounding area are zoned PC and have Residential Low-Medium (RLM) and Open Space (OS) General Plan land use designations. Planning Area 27 is bounded by the 2nd hole of the golf course to the east, Planning Area 26 (single-family neighborhood currently under construction) to the west and north, and Planning Area 28, (single-family neighborhood, currently being rough graded) to the south. The topography of the area is varied consisting of gently sloping to steep hillsides, which generally slope down from north to south. The project site generally slopes down from west to east along Savannah Lane and slopes down from north to south along Golden Star Lane. Planning Area 27 was mass graded previously as part of an approved grading permit and has been subdivided into 35 single-family lots and one open space lot pursuant to the approved final map. Currently the site is being fine graded pursuant to an approved grading permit. The project site is subject to the following regulations: (1) RLM and OS General Plan Designations; (2) East Batiquitos and Mello I Local Coastal Programs; (3) Aviara Master Plan; (4) Chapter 21.38 of the Carlsbad Municipal Code (P-C Zone); (5) Tentative Tract Map (CT 90-34) for Aviara Planning Area 27; and, (6) Zone 19 Local Facilities Management Plan. IV. ANALYSIS The recommendation of approval for this project was developed by analyzing the project's consistency with the applicable policies and regulations listed above. The following analysis section discusses compliance with each of these regulations/policies in the following format: a. a. Discussion of General Plan consistency. b. Discussion of consistency with East Batiquitos and Mello I Local Coastal Programs. c. Table depicting consistency with development standards of the Aviara Master Plan, P-C Zone (Carlsbad Municipal Code, Chapter 21.38) and Tentative Tract Map (CT 90-34) for Aviara Planning Area 27. d. Table depicting Growth Management compliance. General Plan Consistency The proposed project is consistent with the policies and programs of the General Plan. Table 1 below, indicates how the project complies with the elements of the General Plan which are particularly relevant to this proposal. East Batiquitos and Mello I Local Coastal Programs The site is located within the Coastal Zone, East Batiquitos and Mello I Segments, and will as conditioned, be required to process a Coastal Development Permit. The proposed project is in compliance will all policies of the East Batiquitos and Mello I Local Coastal Programs through the mitigation required by the Aviara Master Plan. A portion of the planning area was placed into deed restricted open space as mitigation as required pursuant to the approved tentative map (CT 90-34). No encroachment will occur into the open space area as proposed pursuant to this Site Development Plan. c. Aviara Master Plan. P-C Zoning and Tentative Tract Map (CT 90-34) Development Standards The proposed project complies with the Aviara Master Plan development standards and design criteria as well as with the approved Tentative Tract (CT 90-34) requirements. The proposed architectural elevations and floor plans were previously approved (and constructed) for Aviara Planning Area 14, located to the east of the project site. Planning Area 27 will essentially function as Phase II to the development in Planning Area 14 (both projects are called "Cantata"). There are no outstanding planning issues associated with this project. The project site in located within the P-C Zone which defers specific development standards to the required Master Plan. Planning Area 27 of the Aviara Master Plan establishes that development conform with the standards of the R-1-7500 Zone pursuant to Chapter 21.10 of the Carlsbad Municipal Code unless otherwise noted in the Master Plan. The Master Plan also establishes special design criteria as summarized in Table 2. Table 2 below, depicts the project's compliance with these standards and design criteria. ENVIRONMENTAL REVIEW The Planning Director has determined that this project will not have a significant impact on the environment and therefore, has issued a Negative Declaration on May 10, 1995. In review of the proposed project, the Planning Department has taken into consideration the Environmental Impact Report (BIR 83-02(A)), the Mitigated Negative Declaration for the Aviara Phase II Tentative Map (CT 89-37) and the Negative Declaration for the Tentative Tract Map for PA 27 (CT 90-34) dated October 31, 1991. As designed and conditioned, the Site Development Plan is consistent with the mitigation requirements of these adopted SDP 95-05 CANTATA -'-IA~ PLA~NING AREA 27 JUNE 21, 1995 PAGE6 environmental documents and the appropriate mitigation measures have been incorporated into Planning Commission Resolution No. 3779. The site planning and construction of the 35 individual homes on already subdivided and graded lots will not create additional significant impacts beyond what was already discussed and evaluated in the existing environmental documents.
