AGENDA OF: August 21, 1996 ItemNo.@ Application complete date: April 22, 1996 Project Planner: Michael Grim Project Engineer: Clyde Wickham SUBJECT: CUP 248x2 -CITY HALL MODULARS -Request for an extension of CUP 248xl to allow the continued occupation of a 2,600 square foot modular office building at 1200 Carlsbad Village Drive in Local Facilities Management Zone 1. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 3971 APPROVING a five year extension of CUP 248 (CUP 248x2) based upon the findings and subject to the conditions contained therein. II. INTRODUCTION This proposed five year extension of CUP 248 will allow the continued occupation of the modular office buildings in the City Hall complex at 1200 Carlsbad Village Drive through September 23, 2000. III. PROJECT DESCRIPTION AND BACKGROUND On September 191\ 1990 the Planning Commission approved CUP 248x 1 to continue the occupation of a 2,600 square foot modular office building for City government operation at the northeast comer of Carlsbad Village Drive and Pio Pico. Governmental facilities require Conditional Use Permits pursuant to Section 21.42.010(2)(1) of the Carlsbad Municipal Code. Condition No. 7 of the approving CUP Resolution No. 3095 specifies that CUP 248 was extended for 5 years from the date of approval and may be extended upon written application of the permittee (City of Carlsbad). The applicant, City of Carlsbad, is requesting a 5 year extension of CUP 248 (CUP 248x2) to allow the continued occupation of the modular office buildings at this site. IV. ANALYSIS A. The City Hall Modular continues to be consistent with all applicable plans, policies and regulations described below: 1. Carlsbad General Plan; 0 CUP 248x2 -CITY HALL <;ODULARS AUGUST 21, 1996 PAGE2 2. Local Facilities Management Plan; and 3. Title 21 of the Carlsbad Municipal Code. B. The adopted project findings for CUP 248, which are contained in Planning Commission Resolutions No. 3095 and 2322 still apply to this project (CUP 248x2). C. The adopted project conditions for CUP 248, which are contained in Planning Commission Resolutions No. 3095 and 2322 still apply to this project (CUP 248x2) with the exception of Condition No. 7 of Planning Commission Resolution No. 3097 for CUP 248xl which is amended by Condition No. 2 in Planning Commission Resolution No. 3971 to extend CUP 248x2 for 5 years (through September 23, 2000). D. No formal written complaints regarding CUP 248 have been submitted to the City E. Annual reviews have been conducted for CUP 248 and the project is in compliance with all conditions of approval. F. The extended CUP should be exempted from environmental review per Section 15301, Existing Facilities, of CEQA V. ENVIRONMENTAL REVIEW The Planning Director has determined that this project is exempt from the requirements of the California Environmental Quality Act (CEQA) per Section 15301, Existing Facilities, of the State CEQA Guidelines and will not have any adverse significant impact on the environment ATTACHMENTS: 1.
