Wickham SUBJECT: CUP 96-17 -KIRLIN-SD-224-03 -Request for a Conditional Use Permit to allow the installation of 6 facade-mounted panel antennas and 2 radio equipment cabinets, on an existing industrial office building ("The Campus"). The site is located on the east side of La Place Court between Faraday Avenue and Palomar Airport Road, in the C-M (Heavy Commercial-Light Industrial) Zone, in Local Facilities Management Plan Zone 5. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 4015 APPROVING Conditional Use Permit CUP 96-17, based on the findings and subject to the conditions contained therein. II. INTRODUCTION This application is a request for a conditional use permit (CUP) to allow Personal Communication System (PCS) equipment cabinets and facade-mounted antennas on an existing industrial office building. The site is zoned C-M (Heavy Commercial-Limited Industrial), which means accessory public and. quasi-public utility buildings and facilities are permitted with a CUP. All findings required for the approval of this CUP can be made. III. PROJECT DESCRIPTION AND BACKGROUND Pacific Bell Mobile Services (PBMS) is a PCS communications company and is a public utility licensed to operate in California by the Federal Communications Commission (FCC). PBMS is in the process of building a PCS network throughout San Diego County to service its local subscribers. PCS telecommunications technology (digital wireless) is emerging as an important emergency service and business tool, as well as being convenient for personal and family use. The network is similar to a cellular telephone network, with digital technology improving on the quality of cellular. The project includes installation of 6 facade-mounted panel antennas and 2 radio equipment cabinets on an existing industrial office building. The antennas would be mounted on the exterior of an existing rooftop mechanical equipment screen. Two antennas will be mounted on the north side, two on the south side, and two on the southwestern edge of the screen. The panel antennas are approximately 37" high, 6" wide, and 3" deep. The existing screen wall is 6'2" ., ( CUP 96-17 -KIRLIN-SD-2:L4-03 NOVEMBER 20, 1996 PAGE2 high. None of the antennas will project above the top of this screen. The antennas will be painted to match the color of the screen. The 2 equipment cabinets would be located on the roof of the building inside the existing mechanical equipment screen. They would be approximately 63" tall, 51" wide, and 28" deep and would not project above the screen. The cabinets are constructed of all-weather metal and are completely enclosed for security. Only one of the two cabinets will be installed initially. The second will be installed as network demand warrants. The project site is one of a number of buildings in "The Campus" development. The subject building is surrounded on the north, south, and west by similar industrial office buildings and uses. To the east, across El Camino Real, is an industrial office development and undeveloped area. This proposed project is subject to the following regulations: A. C-M-Heavy Commercial-Limited Industrial Zone (Chapter 21.30 of the Carlsbad Municipal Code); B. Conditional Use Permit Regulations (Chapter 21.42 of the Carlsbad Municipal Code); C. Comprehensive Land Use Plan McClellan-Palomar Airport (CLUP); and D. Growth Management. IV. ANALYSIS Staff is recommending approval of this project for the reasons stated in the staff report. Consequently, this analysis section was developed by analyzing the project's consistency with the applicable plans, policies, regulations and standards listed above and presented through the use of the following text. A. C-M-Heavy Commercial-Limited Industrial Zone Chapter 21.42.010(2)(J)(Conditional Uses-Permitted Uses) allows accessory public and quasi- public buildings and facilities in all zones, including the C-M Zone, by approval of a CUP. B. Conditional Use Permit Conditional land uses such as cellular and PCS communications facilities possess unique and special characteristics which make it impractical to include them as permitted uses "by right" in any of the various zoning classifications (i.e. residential, commercial and industrial). The authority for the location and operation of these uses is subject to Planning Commission review - and the issuance of conditional use permits. The following facts are found to exist for this conditional use permit: ( CUP 96-17 -KIRLIN-SD-224-03 NOVEMBER 20, 1996 PAGE3 ( 1. The requested use is necessary and desirable for the development of the community, in that the community benefits of PCS communications include, but are not limited to, the following: • Wireless communication will improve telecommunication service by providing mobile voice and data transmissions; • Potentially provide enhanced emergency response for police, fire and paramedic services; • Improve voice and data quality through the use of all-digital technology, which will eliminate fading, dropping, and crackling which can interrupt regular wireless calls; • Provide one personal portable phone number for voice, voice mail, pager, data and facsimile; and • This PCS facility has been designed to accommodate approximately 45 calls at one time at peak hour capacity. 2. The proposed project is consistent with the Planned Industrial (PI) General Plan designation in that the proposed use will allow continued provision of wireless communication facilities for the community and region as a whole, including communication for public safety entities. Further, the utility land use is permitted in all zones subject to approval of a CUP. 3. The location of the use is adequate in size and shape to accommodate the utility use and all features necessary to adjust the use to the existing office building have been provided, in that the antennas would be mounted on the facade of the existing roof mechanical screen and will be painted to match the screen, and the equipment cabinets will be located on the roof within the existing mechanical screen. Neither the antennas nor the equipment will project above the existing mechanical screen. Consequently, there will be no adverse visual impacts from the proposed project. 4. The accessory utility use is located on the roof of an existing building and will not generate significant additional traffic. Therefore, the street system serving the use is adequate to properly handle any traffic generated by the use. The use will require occasional maintenance trips ( approximately 1 trip every month) and the proposed facility can be operated from an off site central facility. C. Comprehensive Land Use Plan McClellan-Palomar Airport (CLUP) The project is located within the boundaries of the CLUP. Airport noise will not have an impact on the PCS antennas and the PCS antennas will not interfere with airport activities, and the antennas and screening will not exceed the height allowed in the C-M Zone or the height of the existing structure. Therefore, the project would be compatible with the operations of the airport. ( CUP 96-17 -KIRLIN-SD-224-03 NOVEMBER 20, 1996 PAGE4 D. Growth Management ( The proposed site is located within Local Facilities Management Plan Zone 5. The installation of the antennas and radio equipment cabinets on the roof of an existing building will not result in increased public facilities demands and therefore, the project will not exceed performance standards for public facilities. V. ENVIRONMENTAL REVIEW The installation of small new equipment is a Class 3 Categorical Exemption under the California Environmental Quality Act (Guidelines Section 15303). Pacific Bell Mobile Services is licensed by the FCC to transmit in the 1870-1975 MHz frequency band. Based on a preliminary engineering report on file in the Planning Department, the facility would be in compliance with radio frequency power density standards (ANSI/IEEE C95.l-1992) for the general public, therefore, the project would not have significant impact on the environment.
