AGENDA OF: June 2, 1999 ItemNo.@ Application complete date: January 21, 1999 Project Planner: Eric Munoz Project Engineer: Clyde Wickham SUBJECT: CUP 94-03xl -HOLY CROSS EPISCOPAL CHURCH -Request for an extension of CUP 94-03 to allow the continued operation of a church in the Palomar Airport Business Park at 6066 Corte Del Cedro in the P-M Zone and Local Facilities Management Zone 5. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 4572 APPROVING a five year extension of CUP 94-03 based upon the findings and subject to the conditions contained therein. II. INTRODUCTION This proposed five year extension of CUP 94-03 will allow the Holy Cross Episcopal Church to continue to operate as conditioned at 6066 Corte Del Cedro in the Palomar Airport Business Park through July 20, 2004. III. PROJECT DESCRIPTION AND BACKGROUND On July 20, 1994, the Planning Commission approved CUP 94-03 allowing Holy Cross to occupy 4,570 square feet of multi-tenant industrial space to be utilized for worship services, fellowship meetings, Sunday school, and an office. The facility consists of sanctuary space with seats. No daycare or preschool uses are included. Holy Cross is requesting a 5 year extension of CUP 94-03 to allow the continued operation of a church facility at 6066 Corte Del Cedro in the P-M Zone. Condition No. 5 of the approving CUP Resolution No. 3687 specifies that CUP 94-03 may be extended for a period of 5 years upon written application of the permittee (Holy Cross Episcopal Church). The applicant submitted a request to extend CUP 94-03 on January 11, 1999. IV. ANALYSIS A. The Holy Cross Episcopal Church use continues to be consistent with all applicable plans, policies and regulations described below: 1. Carlsbad General Plan; CUP 94-03xl -REDEEMER 'y THE SEA LUTHERAN CHURCH • APRIL 2, 1997 PAGE2 B. C. D. E. F. V. 2. Local Facilities Management Plan Zone 5; and 3. Title 21 of the Carlsbad Municipal Code. The adopted project findings for CUP 94-03 which are contained m Planning Commission Resolution No. 3687 still apply to this project. The adopted project conditions for CUP 94-03 contained in Planning Commission Resolution No. 3687 still apply to this project (CUP 94-03xl) with the exception of Condition No. 5 which is amended by Condition No. 2 in Planning Commission Resolution No. 4572 to extend CUP 94-03xl for 5 years (through July 20, 2004). No formal written complaints regarding CUP 94-03 have been submitted to the City. Annual reviews have been conducted for CUP 94-03 and the project is in compliance with all conditions of approval. The extended CUP is exempted from environmental review per Section 15301 of CEQA. ENVIRONMENTAL REVIEW The Planning Director has determined that this project is exempt from the requirements of the California Environmental Quality Act (CEQA) per Section 15301, Existing Facilities, of the State CEQA Guidelines and will not have any adverse significant impact on the environment. The present CUP 94-03 expires July 20, 1999. The use of our facility still complies with all the conditions of approval of CUP 94-03 as contained in your Planning Commission Resolution No. 3686 including environmental mitigation conditions. Attached is a check for $540. 00 for the City of Carlsbad fee to provide this requested extension.
