AGENDA OF: July 19, 2000 I Item No.@ Application complete date: April 26, 2000 Project Planner: Greg Fisher Project Engineer: Kathy Farmer SUBJECT: CDP 00-06 -LA COSTA DOWNS, LOT 9 -Request for approval of a Coastal Development Permit to allow for the construction of a new single family residence within the City's Coastal Zone located at 6503 Surfside Lane within the La Costa Downs subdivision (SP 201) within Local Facilities Management Zone 22. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 4796 APPROVING Coastal Development Permit CDP 00-06 based upon the findings and subject to the conditions contained therein. II. INTRODUCTION Pursuant to Section 21.201.030 of the Carlsbad Municipal Code, the construction of a single- family home within the City's Coastal Zone requires the processing and approval of a Coastal Development Permit (CDP). The CDP application was reviewed for consistency with Local Coastal Program (LCP) policies and implementation. The proposed residence is consistent with the La Costa Downs Specific Plan (SP 201) and the Mello 2 segment of the City's LCP. There are no unresolved issues. The staff recommended approval with conditions is supported by the analysis as follows. III. PROJECT DESCRIPTION AND BACKGROUND Project Site/Setting: Infill lot located at the end of a cul-de-sac on the west side of Surfline Lane as shown on the attached location map. The lot area is 0.08 acres {3,498 square feet). Proposed Residential Construction: New 2,103 square foot two story residential structure and attached 450 square foot garage. Proposed Grading: No grading is proposed. Impact on Coastal Resources: None. CDP 00-06 -LA COST .OWNS, LOT 9 July 19, 2000 Page 2 IV. ANALYSIS As shown on the Coastal Development Compliance Table·below, the proposed development is in compliance with all applicable regulations. Building permits may be issued subject to the conditions contained in Planning Commission Resolution No. 4 796. Its unusual shaped lot and substandard size does not allow for the development of a dwelling unit which is comparable in size and shape with other dwelling units on surrounding non-constrained lots within the subdivision. The applicant has requested an Administrative Variance to reduce t_he required 20' front yard setback to 15'. This Administrative Variance (AV 00-02) is pending approval of Planning Commissions approval of CDP 00-06. Administrative Variances granting setback reductions have been previously approved for other similarly constrained lots within the La Costa Downs Subdivision. Building permits may be issued subject to the conditions contained in Planning Commission Resolution No. 4796 Review of Required Coastal Findings 1. Conformance with the Certified Local Coastal Program and all applicable policies. The project is located in the Mello II Local Coastal Program Segment. The project proposes the construction of a new single-family residence in an area designated for single-family residential development. As discussed below, the project complies with all applicable LCP provisions. The LCP Land Use Plan designates the subject site for RM (Residential Medium) density development. The property is zoned R-1, 10,000, but has special zoning provided by Specific Plan 201 in that each existing legal· 1ot can be developed with a single family unit and therefore is consistent with the zoning. CDP 00-06 -LA COSTA~WNS, LOT 9 July 19, 2000 Page 3 2. The proposed residence will be located at 6503 Surfside Lane. The two story residence is consistent with the surrounding development of two story structures within the La Costa Downs subdivision. No agricultural uses currently exist on the site, and the property is not within the Coastal Agricultural Overlay Zone that would require mitigation for conversion to urban uses. There are no sensitive coastal resources within the pre-graded subdivision. The residence is not located in an area of known geologic instability or flood hazard. No public opportunities for coastal shoreline access are available from the subject site and no public access requirements are conditioned for the project since it is not located between the first public road and the ocean. The residentially designated site is not suited for water-oriented recreation activities and the development does not obstruct views of the coastline as seen from public lands or the public right of way. Coastal Overlay Zones. The subject site is located in the Coastal Resource Protection Overlay Zone, however, due to its location on the inland side of Carlsbad Boulevard and the absence of slopes steeper than or equal to 25% inclination and/or native vegetation, additional submittals, standards or requirements do not apply. The project does not require a grading permit. Construction of the project will adhere to the City's Master Drainage and Storm Water Quality Management Plan and Grading Ordinance to avoid increased runoff and soil eros10n. V. ENVIRONMENTAL REVIEW This project is exempt from CEQA per the exemptions listed below: (1) Section 15303 of CEQA exemptions (Class 3) exempts the construction of single family residences in urbanized areas from environmental review.
