AGENDA OF: August 16, 2000 Item No.@ Application complete date: May 1, 2000 Project Planner: Don Neu Project Engineer: Skip Hammann SUBJECT: SDP 96-03(A)/CDP 00-20-CARLSBAD COMPANY STORES PUSHCART PROGRAM -Request for approval of a Site Development Plan Amendment and Coastal Development Permit to place 13 retail pushcarts within the exterior mall areas of the Carlsbad Company Stores Specialty Retail Center on 26.65 acres located at the southeast comer of Paseo Del Norte and Car Country Drive within Planning Area 6 of the Carlsbad Ranch Specific Plan in the Coastal Zone and Local Facilities Management Zone 13. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 4815 and 4816 APPROVING SDP 96-03(A) and CDP 00-20, based on the findings and subject to the conditions contained therein. II. INTRODUCTION This application proposes placing a maximum of 13 pushcarts within the outdoor mall areas interior to the Carlsbad Company Stores. A pushcart is a mobile retail-merchandising unit. The proposed pushcarts for Carlsbad Company Stores have been custom designed to complement the existing architecture. The pushcarts are approximately 5Yz feet wide and 10Yz feet long. Pushcarts are used to create additional synergy and excitement in common areas and walkways. Products typically sold include impulse items. The proposal requires an amendment to the Site Development Plan, which approved the original development. Because of the properties location within the Mello II Segment of the Local Coastal Program a Coastal Development Permit is also required. The proposed pushcarts are in compliance with all city requirements as demonstrated on the project exhibit. The proposal qualifies as categorically exempt from the California Environmental Quality Act. III. PROJECT DESCRIPTION AND BACKGROUND On August 7, 1996 the Planning Commission recommended approval to the City Council of the Carlsbad Company Stores project that was approved by the Council on September 17, 1996. The Carlsbad Company Stores project is a 300,000 square foot specialty retail center on a 26.65 acre site. The conditions of the project approval allow for the development to be constructed in three phases. At this time 2 phases totaling 278,004 square feet have been constructed along with all parking and landscaping for the site. SDP 96-03(A)/CDP 00-20-CARLSBAD COMPANY STORES PUSHCART PROGRAM August 16, 2000 Pa e2 The proposed site development plan amendment and coastal development permit request are to allow 13 pushcarts to be located in the outdoor mall areas interior to the Carlsbad Company Stores. A pushcart is a mobile retail-merchandising unit. They are proposed by the mall's owner to create additional synergy and excitement in common areas and walkways. The pushcarts for the Carlsbad Company Stores have been custom designed to complement the existing architecture of the mall. The proposed pushcarts are approximately 5Yz feet wide and lOYz feet long. The pushcarts and a five-foot perimeter around each have been treated as additional retail space required to be included in the project's parking requirement. Based on this requirement only 13 pushcarts can be provided in order for the parking standard to be complied with. The placement of the pushcarts has been limited by a required separation from the existing structures as well as the maintenance of pedestrian circulation within the outdoor mall areas. No grading or other improvements to the project site are necessary to accommodate the pushcarts. Carlsbad Ranch Specific Plan (SP 207(A)); B. Regional Commercial (R) General Plan Land Use Designation; C. General Commercial, Qualified Development Overlay Zone (C-2-Q); D. Carlsbad Municipal Code, Chapter 21.06, Section 21.06.020-Site Development Plan Findings required by the Qualified Development Overlay Zone; E. Comprehensive Land Use Plan for McClellan-Palomar Airport; SDP 96-03(A)/CDP 00-20-CARLSBAD COMPANY STORES PuSHCART PROGRAM August 16, 2000 Pa e 3 F. Mello II Segment of the Local Coastal Program; G. Growth Management Ordinance (Local Facilities Management Plan Zone 13). IV. ANALYSIS The recommendation for approval for this project was developed by analyzing the project's consistency with the applicable policies and regulations listed above. Therefore, this section will cover the project's compliance with each of the regulations listed above in the order in which they are presented. A. CARLSBAD RANCH SPECIFIC PLAN The Carlsbad Ranch Specific Plan establishes the permitted uses for the site as well as the development standards and design guidelines. The project plans comply with the requirements of the specific plan. The permitted uses for the site include retail business uses as well as others. The proposed pushcarts that will be used for retail sales are a use permitted by the specific plan. The shopping center parking rate of 1 space per 200 gross square feet has been applied to the pushcarts and a 5-foot perimeter around each. As a result the 13 pushcarts require 14 parking spaces. Parking calculations have been provided for the shopping center that include the build- out of all interior tenant space, the outdoor dining area for the Belle Fleur Restaurant and the proposed pushcarts. A total of 1,520 parking spaces are required and presently exist on the site. The necessary parking for the pushcarts is available due to 14 extra parking spaces being provided with the original construction. Parking is being required for the pushcarts because the outdoor mall area is not included in parking requirements for the development. This is in comparison to indoor malls where the entire enclosed space is included in the gross building area used for parking calculations. B. & C. GENERAL PLAN AND ZONING The existing General Plan and Zoning designations for the site were adopted concurrently with the Carlsbad Ranch Specific Plan to achieve consistency. The Regional Commercial (R) General Plan Land Use Designation provides for the proposed retail center use. The specific plan implements the General Plan on the project site and includes a set of goals and policies that are implemented through the plan's standards and design guidelines. Zoning for the site is General Commercial, Qualified Development Overlay Zone (C-2-Q). The zoning designation also permits the use subject to the approval of a site development plan. The specific plan was established with the requirement that each site receive approval of a site development plan and the zoning reflects this criteria. In conclusion the proposed pushcarts that will be used for retail sales are permitted by both the General Plan and Zoning designations. D. SITE DEVELOPMENT PLAN FINDINGS REQUIRED BY THE Q-OVERLAY ZONE The Qualified Development Overlay Zone (Q-Overlay) requires that a site development plan be approved for the proposed use prior to the issuance of any building permit. A site development plan was approved for the Carlsbad Company Stores that did not include the proposed pushcarts and the additional retail area that they represent. The Q-Overlay Zone requires four findings. The required findings with justification for each are contained in the Planning Commission Resolution for the project. This section summarizes the necessary findings and support for each. The requested use is properly related to the site, surroundings and environmental settings as the project design complies with applicable requirements of the Carlsbad Ranch Specific Plan such as parking and setback standards. Additional parking is provided for the increase in retail space created by the placement of the pushcarts on the property. The pushcarts will not be located within any required setbacks or landscape areas. The site is also adequate in size and shape to accommodate the use as all applicable code requirements have been met such as building code separations. The pushcarts will be set back from the buildings a minimum of 20 feet. Adequate areas remain for pedestrian circulation once the pushcarts are located in the outdoor mall. All features necessary to adjust the use to existing and permitted future uses e:xist on the site. Parking required for the proposal is available on the site. No site improvements are necessary to accommodate the proposal. The planned street system is adequate to handle all traffic generated by the use. The proposed use is expected to generate few, new primary trips to the site. Instead the pushcarts will benefit from linked trips that occur when patrons of the shopping center stop at the pushcarts to shop. It is estimated that 75% of the project-generated traffic will be linked in nature, with the remaining 25% being primary or new trips. The total number of new daily trips is estimated to be 34 with 3 new trips being generated in the evening peak hour. E. COMPREHENSIVE LAND USE PLAN FOR McCLELLAN-PALOMAR AIRPORT The project site is located within the Airport Influence Area for McClellan-Palomar Airport. The southern half of the site is located within the 60 CNEL noise contour for the airport. The site is approximately 8,800 feet west of the airport. The airport land use plan identifies the use as being compatible with the noise levels for the site. F. MELLO II SEGMENT OF THE LOCAL COASTAL PROGRAM AND THE COASTAL RESOURCE PROTECTION OVERLAY ZONE The Carlsbad Company Stores project is consistent with the relevant policies of the Mello II Segment of the Local Coastal Program and the Coastal Resource Protection Overlay Zone. Development of the site has been done in conformance with a Coastal Development Permit issued by the California Coastal Commission. Because the pushcarts represent an increase in retail space a Coastal Development Permit is required which the City is able to issue since Coastal Permit authority has been obtained in this area. No impacts to coastal resources will occur, as no site improvements are necessary to accommodate the use. G. GROWTH MANAGEMENT ORDINANCE (LFMP-ZONE 13) The proposed project is located within Local Facilities Management Plan Zone 13 in the northwest quadrant. ENVIRONMENTAL REVIEW The proposed pushcarts qualify as a Categorical Exemption from the California Environmental Quality Act (CEQA) pursuant to Section 15311 (Class 11) of the State CEQA Guidelines. This section exempts from environmental review placement of minor structures accessory to existing commercial facilities.
