AGENDA OF: September 6, 2000 Application complete date: May 9, 2000 Project Planner: Paul Godwin Project Engineer: David Rick SUBJECT: CUP 00-19/CDP 00-22 - GTE WIRELESS AT COLLEGE AND EL CAMINO REAL - Request for a Conditional Use Permit and Coastal Development Permit to allow the installation of an unmanned telecommunications facility with 12 screened, roof mounted panel antennas and a 200 square foot equipment room within an existing office building. The site is located at 5823 Newton Drive in the Planned Industrial (PM) Zone in Local Facilities Management Zone 5. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 4830 and 4831 APPROVING CUP 00-19 and CDP 00-22, based on the findings and subject to the conditions contained therein. II. INTRODUCTION This application is a request for a conditional use permit and a coastal development permit to allow an unmanned telecommunications facility consisting of a 200 square foot equipment room located within the first floor of an existing office building and 12 panel antennas installed on the rooftop behind fiberglass screen painted to match the building. Quasi-public utility facilities are permitted in the Planned Industrial (PM) zone by conditional use permit and all required conditional use findings can be made for the proposed telecommunications facility. III. PROJECT DESCRIPTION AND BACKGROUND GTE Wireless is requesting Planning Commission approval to construct, operate and maintain an unmanned telecommunications facility on a developed light industrial/office site. The site contains an existing two-story light industrial/office building. The General Plan and zoning of the site are Planned Industrial. The surrounding properties are also designated Planned Industrial and are developed with office and industrial uses. The proposed 200 square foot equipment room is located entirely within the existing building. 12 panel antennas will be installed vertically behind a 15'xl5'xlO' fiberglass screen painted to match the building. The panel antennas will be located in the rear and center of the building towards the north edge of the roof, to help obscure the view of the screening enclosure. The existing building's roof is flat with a 2' to 6' high parapet wall around the entire perimeter of the roof. The height of the existing building ranges from 33'-10" to 37'-10", depending on parapet height. The maximum building height, with the proposed antenna enclosure is 43'. CUP 00-19/CDP 00-22 - GlWviRELESS AT COLLEGE AND ELlKMINO REAL September 6, 2000 Page 2 Because of its placement at the rear of the building and also due to parapet height, a maximum of 4' of the antenna screening will be visible from the front (southwest) elevation. The proposed project is subject to the following regulations: A. Planned Industrial Zone (PM) (Chapter 21.34 of the Carlsbad Municipal Code); B. Conditional Use Permit Regulations (Chapter 21.42 of the Carlsbad Municipal Code); C. Mello II Local Coastal Program; D. Growth Management (Chapter 21.90 of the Carlsbad Municipal Code). IV. ANALYSIS The recommendation for approval of this conditional use permit and coastal development permit was developed by analyzing the project's consistency with the applicable City regulations and policies. The project's compliance with each of the above regulations is discussed in detail in the sections below. A. P-MZone The proposed development is consistent with all the applicable development standards and guidelines required by the PM Zone for setbacks, coverage, storage areas and architecture. The equipment room is located in the existing building, thus no increase in square footage is proposed. The proposed antenna screening enclosure does not increase the lot coverage, floor area or parking demand for the site. The combined height of the existing building and proposed antenna screening enclosure is 43'. This proposed height is consistent with the PM zone in that Sections 21.34.070(1) and 21.46.020 of the Zoning Ordinance allow building height protrusions up to 45' in the PM zone for wireless masts and parapet walls. The antenna panels will be mounted vertically behind a fiberglass screen, which would be painted to match the existing structure, therefore, using stealth technology, the panel antennas would not be visible from any elevation. B. Conditional Use Permit Regulations Conditional uses such as digital mobile radio communications facilities possess unique and special characteristics which make it impractical to include them as permitted uses "by right" in any of the various zoning classifications (i.e., residential, commercial, office, industrial). The authority for the location and operation of these uses is subject to Planning Commission review and the issuance of conditional use permits. Staff has reviewed the proposed project and found that all the necessary findings can be made to approve the conditional use permit. The required findings and satisfaction of these findings are contained in Table 1, below. CUP 00-19/CDP 00-22 - GfWvTRELESS AT COLLEGE AND ELlRMINO REAL September 6, 2000 Page 3 Table 1 - CONDITIONAL USE PERMIT FINDINGS AND RESPONSES FINDING PROJECT CONSISTENCY That the requested use is necessary or desirable for the development of the community, is essentially in harmony with the various elements and objectives of the General Plan, including, if applicable, the certified local coastal program, and is not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be located. The requested use is necessary and desirable for the development of the community because of the benefit and demand for digital mobile radio communications. The proposed use is consistent with the General Plan in that the Planned Industrial land use designation does not preclude the provision of quasi-public utility uses, nor is it detrimental to permitted uses in the Planned Industrial Zone and requires no significant changes to the existing site design or function. That the site for the intended use is adequate in size and shape to accommodate the use. The site is adequate in size and shape to accommodate the use. The equipment room is located within the existing building and the antenna screening enclosure will be mounted on the building's rooftop, within the buildable envelope and complies with the Planned Industrial Zone development standards. That all of the yards, setbacks, walls, fences, landscaping, and other features necessary to adjust the requested use to existing or permitted future uses in the neighborhood will be provided and maintained. The antenna screening enclosure will be painted to match the existing building facade to reduce its visibility to the greatest extent possible and the equipment room will be placed within the existing office building's square footage. That the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use. The use generates very little traffic, requiring only routine maintenance visits twice monthly and occasional visits in response to operational problems. C. Mello II Local Coastal Program Applicable policies of the Mello II LCP include those protecting recreation, visual, and environmental resources of the area. The proposed facility will be placed on an existing building and will not significantly impact coastal resources. Visual resources in the area are protected in that all roof mounted antenna will be screened and the equipment room will be housed within the existing building. D. Growth Management The site is located within Local Facilities Management Zone 5. The installation of the facility in the existing building and regular facility maintenance visits will not result in increased public facilities demands; therefore, the proposal will not exceed performance standards for public facilities. ENVIRONMENTAL REVIEW The construction and installation of small new equipment facilities or structures is a Class 3 Categorical Exemption under the California Environmental Quality Act (Guidelines Section 15303). The FCC requires compliance with radio frequency power density standards (ANSI/IEEE C95.1-1992) for the general public, therefore, the project would not have a significant impact on the environment.
