AGENDA OF: October 4, 2000 Project Planner: Paul Godwin Project Engineer: David Rick SUBJECT: CUP 00-21 - NEXTEL-LOKER AVENUE SITE - Request for a Conditional Use Permit to allow the installation of an unmanned digital mobile radio facility with 16 wall mounted flat panel antennas attached to an existing industrial building and the construction of a 200 square foot detached equipment room. The site is located at 2765 Loker Avenue West in the Planned Industrial (PM) Zone in Local Facilities Management Zone 5. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 4844 APPROVING CUP 00-21 for a period of five (5) years, based on the findings and subject to the conditions contained therein. H. INTRODUCTION This application is a request for a conditional use permit to allow for an unmanned digital mobile radio facility consisting of 16 exterior wall mounted flat panel antennas painted to match the existing structure, installed on an existing industrial building and construct a 200 square foot detached equipment room at the rear of site. Quasi-public utility facilities are permitted in the Planned Industrial (PM) zone by conditional use permit and all required conditional use findings can be made for the proposed digital mobile radio communications facility. M. PROJECT DESCRIPTION AND BACKGROUND Nextel Communications is a digital communications company licensed to operate in California by the Federal Communications Commission (FCC). Nextel Communications is currently in the process of developing a digital mobile radio system network as an alternative to current "cellular" telephone systems. This technology provides digital dispatch service to large fleet users, wireless data transmission and provides emergency communications during periods when normal communications facilities are disrupted due to earthquake, flood or similar disaster. The proposed site is developed with an existing industrial building and is owned by COBC 18, LLC. The building is located at 2765 Loker Avenue West and is within the Carlsbad Airport Business Center Specific Plan (SP 200). The General Plan and zoning of the site is Planned Industrial. The surrounding properties are also designated Planned Industrial and are developed with office and industrial uses. Sixteen flat panel antennas measuring one foot wide by four feet high will be mounted vertically on the south, west and north sides of the building in groups of four. The antennas will be mounted towards the top of the roof parapet edge and will be painted CIO . . CUP 00-21— NEXTEL-LOKER AVENUE SITE October 4, 2000 Page 2 to match the existing building. No antennas would be mounted on the street-side elevation. Two global positioning satellite (GPS) antennas and one base mobile radio (BMR) antenna will be located on the existing building's rooftop and will not be visible from street level. The proposed 200 square foot equipment room would be located in the northwest corner of the lot, behind the existing building. The equipment room measures 20'xlO' and 10' in height and is architecturally compatible with the existing building. The exterior walls will be concrete and painted to match the existing concrete building. There is one point of access to the equipment room, placed at the rear of the building on the west elevation. No required parking would be eliminated by the proposed equipment room. IV. ANALYSIS The proposed project is subject to the following regulations: A. Planned Industrial Zone (P-M) (Chapter 21.34 of the Carlsbad Municipal Code); B. Carlsbad Airport Business Center Specific Plan (SP 200) C. Conditional Use Permit Regulations (Chapter 21.42 of the Carlsbad Municipal Code); D. Growth Management (Chapter 21.90 of the Carlsbad Municipal Code). The recommendation for approval of this conditional use permit was developed by analyzing the project's consistency with the applicable City regulations and policies. The project's compliance with each of the above regulations is discussed in detail in the sections below. A. P-M Zone The proposed development is consistent with all the applicable development standards and guidelines required by the P-M Zone for setbacks, coverage, storage areas and architecture. The proposed equipment room maintains a 10' landscaped setback from all property lines, a 20' rear yard building setback and the total lot coverage with the proposed equipment room is 30.1%, which is under the 50% maximum lot coverage allowed in the P-M Zone. The proposed equipment room will be 10' in height. The proposed panel antennas will be mounted to the exterior walls of the existing building and will not increase the height of the building or decrease setbacks. The proposed unmanned digital radio communications site would require maintenance approximately twice per month and thus would not create a demand for additional on-site parking. The P-M Zone requires that an amendment to the existing approved Planned Industrial Permit (PIP 91-02) be processed to allow for the addition of the 200 square foot equipment room. This is an administrative permit and will be processed following Planning Commission review. B. Carlsbad Airport Business Center Specific Plan The proposed digital mobile radio communications facility meets all setback, height, design and other standards required by the Carlsbad Airport Business Center Specific Plan (SP 200). Conditional Use Permit Regulations Conditional uses such as digital mobile radio communications facilities possess unique and special characteristics which make it impractical to include them as permitted uses "by right" in any of the various zoning classifications (i.e., residential, commercial, office, industrial). The authority for the location and operation of these uses in subject to Planning Commission review and the issuance of conditional use permits. Staff has reviewed the proposed project and found that all the necessary findings can be made to approve the conditional use permit. The required findings and satisfaction of these findings are contained in Table 1, below. ENVIRONMENTAL REVIEW The construction and installation of small new equipment facilities or structures is a Class 3 Categorical Exemption under the California Environmental Quality Act (Guidelines Section 15303). The FCC requires compliance with radio frequency power density standards (ANSI/IEEE C95.1-1992) for the general public, therefore, the project would not have a significant impact on the environment.
