AGENDA OF: November 1, 2000 Application complete date: July 25, 2000 Project Planner: Greg Fisher Project Engineer: David Rick SUBJECT: CDP 00-30 - DAUN SECOND DWELLING UNIT - Request for approval of a Coastal Development Permit to allow for the construction of a detached second dwelling unit to an existing single-family residence within the City's Coastal Zone located at 334 Date Avenue within Local Facilities Management Zone 1. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 4857 APPROVING Coastal Development Permit CDP 00-30 based upon the findings and subject to the conditions contained therein. II. INTRODUCTION Pursuant to Section 21.201.030 of the Carlsbad Municipal Code, the construction of a second dwelling unit within the City's Coastal Zone requires the processing and approval of a Coastal Development Permit (CDP). The CDP application was reviewed for consistency with Local Coastal Program (LCP) policies and implementation. The proposed residence is consistent with the Mello 2 segment of the city's LCP. There are no unresolved issues. The staff recommended approval with conditions is supported by the analysis as follows. III. PROJECT DESCRIPTION AND BACKGROUND Project Site/Setting: Existing single-family lot and single story home located on the north side of Date Avenue as shown on the attached location map. The site is near level with a gradual slope to the east. The lot area is 0.46 acres (20,171 square feet). Proposed Residential Construction: New detached second dwelling unit totaling 638 square feet on an existing single-family lot and home. The second dwelling unit will be constructed above a proposed 1,056 square foot garage. Proposed Grading: A grading permit will not be required for this project. Impact on Coastal Resources: None. ANALYSIS As shown on the Coastal Development Compliance Table below, the proposed development is in compliance with all applicable regulations. Building permits may be issued subject to the conditions contained in Planning Commission Resolution No. 4857. Conformance with the Certified Local Coastal Program and all applicable policies. The project is located in the Mello II Local Coastal Program Segment. The project proposes the construction of a detached second dwelling unit in an area designated for single-family and two-family residential development. As discussed below, the project complies with the applicable Local Coastal Program provisions. The LCP Land Use Plan designates the subject site for RM (Residential Medium) density development. Affordable Housing Policy 1-1 of the Mello II LCP allows for the development of second dwelling units subject to compliance with all applicable LCP provisions, with the exception of base density. The proposed second dwelling unit is architecturally compatible with the primary unit and is consistent with the surrounding development of one-and two-story structures. The second-story second dwelling unit is located at the rear of the property and will not obstruct views of the coastline as seen from public lands or the public right-of-way or otherwise damage the visual beauty of the coastal zone. No agricultural uses currently exist on the site, nor are there any sensitive resources on the developed property. The second dwelling unit is not located on an area of known geologic instability or flood hazard. No public opportunities for coastal shoreline access are available from the subject site since it is not located between the first public road and the ocean, and no public access requirements are conditioned for the project. The residentiary designated site is not suited for water-oriented recreation activities. CDP 00-30 - DAUN SECOND DWELLING UNIT November 1,2000 Page 3 2. Coastal Overlay Zones. The subject site is located in the Coastal Resource Protection Overlay Zone, however, due to its inland location and the absence of slopes steeper than or equal to 25% inclination and/or native vegetation, additional submittals, standards or requirements do not apply. The project does not require a grading permit. Construction of the project will adhere to the City's Master Drainage and Storm Water Quality Management Plan and Grading Ordinance to avoid increased runoff and soil erosion. V. ENVIRONMENTAL REVIEW This project is exempt from CEQA per the exemptions listed below: (1) Section 15303 of CEQA exemptions exempts the construction of a second dwelling unit in a residential zone in urbanized areas from environmental review.
