AGENDA OF: November 1, 2000 Project Planner: Michael Grim Project Engineer: David Rick SUBJECT: CUP 00-23 - TELIGENT ANTENNAS - Request for a Conditional Use Permit to allow the installation of twelve 24-inch diameter antennas and one 36-inch diameter antenna on the roof of an existing industrial building, located west of Yarrow Drive between Palomar Airport Road and Camino Vida Roble in Local Facilities Management Zone 5. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 4864, APPROVING Conditional Use Permit CUP 00-23, based upon the findings and subject to the conditions contained therein. H. INTRODUCTION The proposal involves the installation of thirteen roof-mounted antennas on an existing industrial building located southwest of the intersection of Yarrow Drive and Palomar Airport Road. Twelve of the antennas measure 24 inches in diameter and one measures 36 inches in diameter; all antennas would be mounted on masts and extend just above the top of the existing equipment screen wall. The existing building, with or without the proposed antennas, is virtually indiscernible from public views, as shown on the attached photographs and photo simulations. The project conforms to all applicable regulations and staff has no issues with the proposal. M. PROJECT DESCRIPTION AND BACKGROUND Teigent Communications is requesting a Conditional Use Permit to allow the installation of thirteen roof-mounted antennas on an existing industrial building, located southwest of the intersection of Yarrow Drive and Palomar Airport Road. The site is designated Planned Industrial (PT) in the City's General Plan and is zoned Planned Industrial (P-M). With the exception of McClellan-Palomar Airport to the north, the site is surrounded by industrial development. There are currently four buildings on the project site with the antennas being proposed on the southernmost building (2131 Palomar Airport Road), as shown on Exhibit "B", dated November 1, 2000. As shown on Exhibits "C" - "E", dated November 1, 2000, the proposed antennas would be located along the perimeter of the existing rooftop equipment screen wall. They would be attached to the inside of the screen wall by a three-inch diameter mast. All antennas would be above the existing screen wall. The two-foot diameter antennas would mostly be located on the southern edge, with some on the northwest and northeast corners of the screen. No additional equipment is needed for the antenna-based telephone system at this location. The attached photo siniluations illustrate the visibility, or lack thereof, of the existing building's rooftop and the proposed antennas. Given the distance and obscurity from Palomar Airport Road and the site's elevation above Yarrow Drive and other nearby roadways, the proposed antennas would not be easily visible from public views. Therefore, staff is supportive of the placement of the antennas on top of the existing roof screen. Teligent Communications is a telephone company licensed to serve the local area by the Federal Communications Commission (FCC). Teligent is not a cellular or PCS provider; rather they offer a fixed digital wireless network for telephone service instead of street-fiber cables. The Teligent network cannot be accessed from a mobile source. Since the network operates with small roof-mounted microwave antenna dishes, it is anticipated that additional roof-mounted antenna will be necessary within the City of Carlsbad. The Teligent Antenna project is subject to the following regulations: A. General Plan; B. P-M - Planned Industrial Zone (Chapter 21.34 of the Zoning Ordinance); C. Conditional Use Ordinance (Chapter 21.42 of the Zoning Ordinance); D. McClellan-Palomar Airport Comprehensive Land Use Plan; B. Growth Management Ordinance (Chapter 2.90 of the Zoning Ordinance); F. Zone 5 Local Facilities Management Plan. IV. ANALYSIS The recommendation for approval of this project was developed by analyzing the project's consistency with the applicable policies and regulations listed above. The following analysis section discusses compliance with each of these regulations/polices utilizing both text and tables. A. General Plan The Teligent Antenna project is consistent with the applicable policies and programs of the General Plan. Particularly relevant to the rooftop antenna proposal are the Land Use and Public Safety Elements. Table 1 below indicates how the project complies with these particular elements of the General Plan. Given the above, the Teligent Antenna proposal is consistent with the applicable goals, programs and policies of the General Plan. B. P-M - Planned Industrial Zone The project site is zoned Planned Industrial (P-M) and is therefore subject to the regulations contained in Chapter 21.34 of the Zoning Ordinance. The antenna use is conditionally allowed in the P-M zone. The development standards of the P-M zone deal mostly with the placement of buildings and other structures. Since the antennas are located on the existing industrial building, the proposal conforms to the existing setbacks and lot coverage standards. No landscaping is proposed or required with the project. Since the project does not add any floor area to the existing building, no additional parking or employee eating areas are needed. The antenna would extend two to three feet above the existing equipment screen, however they would not be easily visible from public views as discussed in Section C below. Given the above, the proposed Teligent Antenna project is consistent with the P-M zone. C. Conditional Use Ordinance The proposed communication antenna are considered a conditional use and are therefore subject to the regulations contained in Chapter 21.42 of the Zoning Ordinance. There are four standard findings that must be made in order to allow the addition of a conditional use to any property. Table 2 below lists the required findings and discusses the project's consistency with those findings. McClellan-Palomar CLUP The project site is located within the Airport Influence Area for the McClellan-Palomar Airport. All uses and development on the site are therefore subject to the regulations of the Comprehensive Land Use Plan for the McClellan-Palomar Airport (CLUP). The CLUP mostly regulates the types of uses allowed based upon the projected noise generation contours around the airport. The project site is located in the 60-65 CNEL noise contour interval, which allows residential, commercial and industrial uses. Since the proposed antennas are not designed for human occupancy, the proposal is consistent with the use restrictions of the CLUP. The project site is not located within the Runway Protection Zone (RPZ) or the Flight Activity Zone (FAZ), therefore no height restrictions apply to the project. Therefore, the Teligent Antenna proposal is consistent with the Comprehensive Land Use Plan for the McClellan-Palomar Airport. E. Growth Management Ordinance The proposed antennas do not add any square footage to the existing building and, therefore, do not generate any impacts to the Growth Management performance standards. Zone 5 Local Facilities Management Plan The Teligent Antenna site is located in Local Facilities Management Zone 5. There are no special development conditions in the zone plan that apply to this non-residential project. All public facilities needed to serve the development are already in place. The project would not generate any additional traffic, therefore no Traffic Impact Fees are required. Since no additional floor area is proposed, no Public Facilities Fees would be collected. Given that all public facilities necessary to serve the existing industrial building are already in place, and given that the project would not generate any additional facilities demands, the Teligent Antenna project is consistent with the Zone 5 Local Facilities Management Plan. V. ENVIRONMENTAL REVIEW The Teligent Antenna proposal represents the construction and installation of small new equipment facilities or structures, which qualifies as a Class 3 Categorical Exemption according to Section 15303 of the State CEQA Guidelines. The radio frequency power density is controlled by FCC regulations (ANSI/IEEE C95.1-1992) for the general public, therefore no adverse environmental impacts would occur with the project as designed and regulated.
