I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 4890 APPROVING Conditional Use Permit No. CUP 00-29 for a period of five (5) years, based on the findings and subject to the conditions contained therein. II. INTRODUCTION The applicant is requesting approval of a Conditional Use Permit (CUP) to allow the installation of an unmanned digital Personal Communications Service (PCS) facility which would consist of six ( 6) panel antennas mounted on the walls of an existing building and the installation of support equipment located behind a 6-foot high screen wall on a developed industrial site located at 2875 Loker Avenue East in the Carlsbad Airport Business Center Specific Plan Area. Quasi- public utility facilities are permitted in the Planned Industrial (PM) zone by conditional use permit and all required conditional use permit findings can be made for the proposed telecommunications facility. III. PROJECT DESCRIPTION AND BACKGROUND Pacific Bell Wireless (PBW) is requesting approval to install a Personal Communications Services (PCS) facility on an existing two-story, 43,300 square foot building located on a 3.12 acre site in the Carlsbad Oaks Business Park at 2875 Loker Avenue East. Properties in the vicinity are developed and accommodate a variety of light industrial and office uses. The proposed PCS facility would consist of a total of six panel antennas located on the south, east, and northwest building walls. The 4.5 feet long by 8 inch wide panels will be located approximately 6 inches below the top of the building parapet which is 28 feet tall. The concrete tilt-up building construction precludes the antennas from being recessed into the building fa;ade as has been done at other locations throughout the City. The proposed equipment area would be located within a landscape planter on the east side of the building and will be enclosed within an 8' x 15'-10" space. The 6-foot high enclosure wall will have an exterior finish to match the existing building. CUP 00-29 -TECHBUIL~W AREHOUSE SD-377-04 January 3, 2001 Pa e2 .. ,.,, The applicant, Pacific Bell Wireless, has been authorized by the Federal Communications Commission (FCC) to construct and operate a new wireless, digital PCS network throughout California. The proposed site was chosen by the applicant because of its location and elevation which will enable PBW to meet the capacity and coverage needs in this area. The proposed project is subject to the following regulations: A. Carlsbad Airport Business Center Specific Plan (SP-200) and Planned Industrial Zone (P-M) (Chapter 21.34 of the Carlsbad Municipal Code); B. Conditional Use Permit Regulations (Chapter 21.42 of the Carlsbad Municipal Code); C. Comprehensive Land Use Plan McClellan-Palomar Airport; D. Growth Management (Chapter 21.90 of the Carlsbad Municipal Code). IV, ANALYSIS The recommendation for approval of this conditional use permit was developed by analyzing the project's consistency with the applicable City regulations and policies. The project's compliance with each of the above regulations is discussed in detail in the sections below. A. Carlsbad Airport Business Center Specific Plau (SP -200) and P-M Zone The project site is regulated by the Carlsbad Airport Business Center Specific Plan which specifies the types of uses permitted by right ( office, manufacturing, warehouse, and distribution uses), however, it does not specify the type of conditional uses permitted on the site. Conditional uses permitted in the P-M zone are therefore determined by Chapters 21.34 (Planned Industrial Zone) and 21.42 (Conditional Uses) of the Carlsbad Municipal Code which allow quasi-public utility uses in all zones subject to approval of a conditional use permit. The proposed development is consistent with all applicable development standards and guidelines required by SP-200 and the P-M zone for height, setbacks, coverage, storage areas and architecture since the installation will be located on an existing building. The equipment area is located in a landscape area adjacent to the building wall and will be enclosed by a 6-foot high wall for screening. The equipment area does not encroach into any required parking areas or drive aisles. As part of the project, one tree will need to be relocated or replaced in kind and any damaged plants or irrigation systems will require replacement. The proposal does not result in an increase of the lot coverage, floor area, or parking demand for the site. The proposed panel antennae will be mounted on the exterior of the south, east and northwest walls of the existing building and will be painted to match the existing structure and therefore, will be integrated into the existing architecture. B. Conditional Use Permit Regulations Conditional uses such as PCS communication facilities possess unique and special characteristics which make it impractical to include them as permitted uses "by right" in any of the various zoning classifications (i.e., residential, commercial, office, industrial). The following required conditional use permit findings for the proposed telecommunications facility can be made: 1. The proposed use is: a) necessary and desirable for the development of the community in that the community benefits of wireless communications include improved telecommunications service for emergency services and individuals; b) consistent with the General Plan in that the Planned Industrial (PI) land use designation does not preclude the provision of quasi-public utility uses; and c) not detrimental to permitted uses in the Planned Industrial zone in that the use is integrated into the existing building and requires no significant changes to the site design or function; 2. The proposed site is adequate in size and shape to accommodate the use in that the panel antennas will be mounted on the existing building walls and the location of the equipment area will not impact existing site features such as parking and circulation drive aisles, and the proposal complies with the Carlsbad Airport Business Center development standards; 3. All features necessary to adjust the requested use to the existing use are provided in that the wall mounted antennas will be painted to match the existing building and the equipment enclosure will be constructed to match the existing exterior building walls; and 4. The street system serving the proposed use would not be impacted by the proposed conditional use in that additional vehicle trips are limited to occasional equipment maintenance by service personnel. C. Comprehensive Land Use Plan McClellan-Palomar Airport The proposed site is located with the Comprehensive Land Use Plan for the McClellan-Palomar Airport. The installation of the antennas on the building walls and the equipment enclosure on the ground will not impact the flight operations of the airport. In addition, airport-generated noise will not have an impact on the facility, since there are no onsite employees associated with the facility. D. Growth Management The site is located within Local Facilities Management Zone 5. The installation of the panel antennas on the existing building will not result in increased public facilities demands; therefore, the proposal will not exceed performance standards for public facilities. V. ENVIRONMENTAL REVIEW The construction and installation of small new equipment facilities or structures is a Class 3 Categorical Exemption under the California Environmental Quality Act (Guidelines Section 15303). PBW is licensed by the FCC to receive and transmit by radio waves operating in the 1850-2100 MHz frequency block.
