AGENDA OF: February 21, 2001 Item No.® Application complete date: September 11, 2000 Project Planner: Greg Fisher Project Engineer: David Rick SUBJECT: CDP 00-26 -MULLINS RESIDENCE -Request for approval of a Coastal Development Permit to allow for the construction of a single-family residence within the City's Coastal Zone located along the east side of Jefferson Street, southwest of the Interstate 5 freeway, within Local Facilities Management Zone 1. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 4925 APPROVING Coastal Development Permit CDP 00-26 based upon the findings and subject to the conditions contained therein. II. INTRODUCTION Pursuant to Section 21.201.030 of the Carlsbad Municipal Code, the construction of a single- family home within the City's Coastal Zone requires the processing and approval of a Coastal Development Permit (CDP). The CDP application was reviewed for consistency with LCP policies and implementation. The proposed residence is consistent with the Mello II segment of the city's LCP. There are no unresolved issues. The staff recommended approval with conditions is supported by the analysis as follows. III. PROJECT DESCRIPTION AND BACKGROUND Project Site/Setting: Infill lot located on the east side of Jefferson Street as shown on the attached location map. The site is mostly level and sits slightly above street grade. The lot area is .26 acres (11,426 square feet). Proposed Residential Construction: New 2,933 square foot residential structure and attached 750 square foot three car garage. The two-story Victorian style structure will be constructed of wood framing with stucco and wood siding and a decorative composition shingle roof. Proposed Grading: No grading is proposed which would require a grading permit. Impact on Coastal Resources: None. CDP 00-26 -MULLINS RE.ENCE February 21, 2001 Page2 IV. ANALYSIS As shown on the Coastal Development Compliance Table below, the proposed development is in compliance with all applicable regulations. Building permits may be issued subject to the conditions contained in Planning Commission Resolution No. 4925. Conformance with the Certified Local Coastal Program and all applicable policies. The project is located in the Mello II Local Coastal Program Segment. The project proposes the construction of a new two-story single-family residence in an area designated for single and multi-family residential development. As discussed below, the project complies with the applicable Local Coastal Program provisions. The LCP Land Use Plan designates the subject site for RMH (Residential Medium High) density development, which allows 11.5 du/ac. Based on a density of 11.5 du/ac, the lot could accommodate three dwelling units. The proposed residence will be located on the east side of Jefferson Street, just southwest of the Interstate 5 freeway. The two-story residence is consistent with the surrounding development of one-and two-story structures. The two-story residence will not obstruct views of the coastline as seen from public lands or the public right-of-way or otherwise damage the visual beauty of the coastal zone. No agricultural uses currently exist on the site, nor are there any sensitive resources located on the undeveloped property. The proposed residence is not located on an area of known geologic instability or flood hazard. No public opportunities for coastal shoreline access are available from the subject site since it is not located between the first public road and the ocean, and no public access requirements are conditioned for the project. The residentially designated site is not suited for water-oriented recreation activities. CDP 00-26 -MULLINS RE'DENCE February 21, 2001 Page 3 2. Coastal Overlay Zones. The subject site is located in the Coastal Resource Protection Overlay Zone, however, due to its location and the absence of slopes steeper than or equal to 25% inclination and/or native vegetation, additional submittals, standards or requirements do not apply. The project does require a grading permit. Construction of the project will adhere to the City's Master Drainage and Storm Water Quality Management Plan and Grading Ordinance to avoid increased runoff and soil erosion. V. ENVIRONMENTAL REVIEW This project is exempt from CEQA per the exemptions listed below: 1) Section 15303 of CEQA exemptions (Class 3) exempts the construction of single- family residences in urbanized areas from environmental review.
