AGENDA OF: May 2, 2001 Application complete date: March 12, 2001 Project Planner: Barbara Kennedy Project Engineer: David Rick SUBJECT: CUP 96-18(BVCDP 00-56 - SD 184-05 PACIFIC BELL WIRELESS - Request for approval of a Conditional Use Permit amendment and a Coastal Development Permit to allow one additional panel antenna and a new equipment enclosure for the existing Pacific Bell Wireless telecommunications facility located at 720 Macadamia Drive in the C-2 Zone, within the Coastal Zone, and in Local Facilities Management Zone 22. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolutions No. 4935 and 4972 APPROVING CUP 96-18(6) and CDP 00-56 for a period of five (5) years based on the findings and subject to the conditions contained therein. II.INTRODUCTION This application is a request for a Conditional Use Permit (CUP) amendment and a Coastal Development Permit (CDP) to allow Pacific Bell Wireless to add one additional panel antenna and a new equipment enclosure to its existing unmanned wireless telecommunications facility located at the Quality Inn (formerly Travelodge) at 720 Macadamia Drive. Quasi-public utility facilities are permitted in the General Commercial (C-2) zone by conditional use permit and all required conditional use permit and coastal development permit findings can be made for the proposed telecommunications facility. III. PROJECT DESCRIPTION AND BACKGROUND The proposed Conditional Use Permit amendment is requested to expand the existing Pacific Bell Wireless (PBW) telecommunications facility. The unmanned site, which is located at the Quality Inn, currently consists of 4 panel antennas and an equipment cabinet. The existing panels are located at the northeast corner of the building and are concealed within the existing stucco wall so that they are not visible from the exterior of the building. The new antenna will be located near the southwest corner of the building and will also be concealed within the wall. The proposed 14' x 12' equipment enclosure, which is located at the southeast comer of the building, will accommodate both the existing and proposed equipment. The equipment will be enclosed by an 8 foot high stucco wall (painted to match the building) with a green wood trellis above. The design of the enclosure will match an existing equipment enclosure which is located just to the east of the proposed enclosure. The Planning Commission approved the original Conditional Use Permit (CUP 96-18) on August 20, 1996 for a period of five years. On April 5, 2000, the applicant applied for an amendment to o CUP 96-18(B)/CDP 00-5W SD 184-05 PACIFIC BELL May 2, 2001 Page 2 the facility (CUP 96-18(A)) but that application was withdrawn on August 23, 2000. The original project approved by CUP 96-18 will expire on August 20, 2001. However, if CUP 96- 18(B) is approved, it will supersede all conditions of approval for CUP 96-18 and will impose all the conditions for CUP 96-18(B) upon CUP 96-18 as shown in Condition No. 11 of Resolution No. 4935. The new expiration date for the entire facility would be May 2, 2006. In addition, when the original project was submitted in 1996, the City did not have authority to issue Coastal Development Permits and the project was required to obtain a coastal permit approval from the California Coastal Commission. Since that time, the City has acquired the authority to issue Coastal Development Permits in the Mello I Segment of the Coastal Zone. Therefore, the entire project is being reviewed for consistency with Coastal Development regulations. PBW is a Personal Communications Services (PCS) communications company and is a public utility licensed to operate in California by the Federal Communications Commission (FCC). PBW is in the process of building and expanding its PCS network throughout San Diego County to service its local subscribers. PCS telecommunication technology (digital wireless) has been established as an important emergency service and business tool, as well as being convenient for personal and family use. The proposed addition is necessary to meet increased coverage demands for PBW customers. IV. ANALYSIS The proposed project is subject to the following regulations: A. General Commercial Zone (C-2) (Chapter 21.28 of the Carlsbad Municipal Code); B. Conditional Use Permit Regulations (Chapter 21.42 of the Carlsbad Municipal Code); C. Mello I Segment of the Local Coastal Program, Coastal Development Procedures, and the Coastal Resources Protection Overlay Zone (Chapter 21.201, 21.203, and 21.205; D. Growth Management (Chapter 21.90 of the Carlsbad Municipal Code). The recommendation for approval of this conditional use permit and coastal development permit was developed by analyzing the project's consistency with the applicable City regulations and policies. The project's compliance with each of the above regulations is discussed in detail in the sections below. A. General Commercial Zone The proposed development is consistent with all applicable development standards and guidelines required by the C-2 zone for setbacks, coverage, storage areas and architecture since the installation of the new antenna will be located within an existing building and the equipment building meets all setback requirements. The proposal does not increase the lot coverage, floor area, or parking demand for the site. The proposed panel antenna will be mounted within the parapet of the existing building walls similar to the existing antennas, and will be covered with a simulated stucco screen painted to match the existing structure and therefore integrated into the CUP 96-18(B)/CDP 00-5^ SD 184-05 PACIFIC BELL May 2, 2001 Page3 architecture. The new equipment room is located near the rear of the building and has been designed to match the other enclosure on the site. B. Conditional Use Permit Regulations Conditional uses such as cellular communications facilities possess unique and special characteristics which make it impractical to include them as permitted uses "by right" in any of the various zoning classifications (i.e., residential, commercial, office, industrial). The authority for the location and operation of these uses is subject to Planning Commission review and the issuance of conditional use permits. The following required conditional use permit findings for the proposed telecommunications facility can be made: 1. The proposed use is: a) necessary and desirable for the development of the community in that the community benefits of wireless communications include improved telecommunications service for emergency services and individuals; b) consistent with the General Plan in that the Commercial land use designation does not preclude the provision of quasi-public utility uses; and c) not detrimental to permitted uses in the Commercial zone in that the use is integrated into the existing commercial building and requires no significant changes to the site design or function; 2. The proposed site is adequate in size and shape to accommodate the use in that the existing and proposed panel antennas are mounted within the parapet of the existing building and the equipment room is located within an existing landscape area; 3. All features necessary to adjust the requested use to the existing use are provided in that the wall mounted antennas are located between the building walls and are covered with a simulated stucco screen painted to match the building; and 4. The street system serving the proposed use would not be impacted by the proposed conditional use in that additional vehicle trips are limited to occasional equipment maintenance by service personnel. C. Mello I Segment of the Local Coastal Program The site is located within the Mello I segment of the City's Coastal Zone and is subject to the corresponding land use policies and implementing ordinances. These policies and ordinances emphasize topics such as preservation of agriculture and scenic resources, protection of environmentally sensitive resources, provision of shoreline access, and the prevention of geologic instability and erosion. The site is currently developed and the proposed facility will be located within an existing building and the equipment building will be integrated into an existing landscape area. No agricultural or environmentally sensitive lands exist on site. Since the project site is located approximately one-half mile from the Pacific Ocean, no shoreline development regulations apply. No scenic resources exist on or near the developed site. Given the above, the project is consistent with the Mello I land use policies and the applicable implementing ordinances. The installation of the additional panel antenna on the building will not result in increased public facilities demands; therefore, the proposal will not exceed performance standards for public facilities. V. ENVIRONMENTAL REVIEW The construction and installation of small new equipment facilities or structures is a Class 3 Categorical Exemption under the California Environmental Quality Act (Guidelines Section 15303). The FCC requires compliance with radio frequency power density standards (ANSI/IEEE C95.1-1992) for the general public, therefore, the project would not have a significant impact on the environment.
